We cannot deny his credit by defining and protecting these rights. and, in order to be protected, legislative mechanisms established by law had to be adopted, Each mechanism has its own competence and area of protection, and the National Court is not the only body in Algeria to protect intellectual property. After Algeria's accession to the Paris Agreement, it established the Algerian National Institute for Industrial Property. s moral rights, as well as the application of national policy in this area, This institutional mechanism has been accompanied by a legislative mechanism, namely the enactment of penal and penal protection to protect these rights from attacks, in order to provide an appropriate environment for the author, creator and intellectual creativity in order to keep abreast of the world's development. But this remains insufficient, because we live within an international community and an outside world, and because of the high level of friction and interaction. We had to deal with external and international mechanisms, especially because Algerian legislators were affected by them. WIPO and WTO are the most important international institutions for the protection of intellectual property aimed at upholding intellectual property rights worldwide, achieved with the cooperation of the world's States and, where appropriate, with the assistance of other international organizations, as well as regional organizations and federations specializing in intellectual property protection and its role is only complementary to the role played by international organizations to protect these rights, All these efforts to protect intellectual property are merely important and have an impact on the world economy and on States' policies. ……………………. الملخص يعد موضوع الملكية الفكرية من أهم المواضيع التي أولى لها المشرع الجزئري اهتمام كبير وعمل على حمايتها منذ استقلال، فكان أول قرار تم اتخاذه في هذا الشأن هو مواصلة العمل بالقوانين الفرنسية إلا وما يتعارض منها والسيادة الوطنية، واستمر العمل بها إلى غاية صدور أول تشريع وطني نص على إنشاء جهاز خاص لحماية هذه الفئة وحماية حقوقهم وهو الديوان الوطني لحقوق المؤلف، الذي جاء بغرض حماية حقوق المؤلف والحقوق المجاورة، كما يعمل وسيط بين المؤلفين ومستغلي المصنفات، وغيرها من المهام الموكلة له، كما رأينا كذلك أن الحق المحمي منقسم إلى شقين معنوي والمالي. ولا نستطيع أن ننكر فضله من خلال تحديده لهذه الحقوق وحمايتها، وحتى تتم الحماية كان لا بد من إقرار آليات تشريعية حددها القانون، ولكل آلية اختصاصها ومجال خاص تحميه، ولا يعد الديوان الوطني هو الهيئة الوحيدة في الجزائر لحماية الملكية الفكرية، فبعد انضمام الجزائر إلى اتفاقية باريس قامت بإنشاء المعهد الوطني الجزائري للملكية الصناعية، الذي جاء بغية حماية الحقوق المعنوية للمبدعين وكذا تطبيق السياسة الوطنية في هذا المجال، ورافق هذه الآلية المؤسساتية آلية تشريعية تمثلت في سن حماية جزائية وعقابية لحماية هذه الحقوق من الاعتداءات وهذا من أجل توفير البيئة المناسبة للمؤلف والمبدع والمفكر للإبداع في سبيل مواكبة التطور الذي يشهده العالم، وهذا على الصعيد الداخلي. لكن يبقى هذا غير كافي ولأننا نعيش داخل مجتمع دولي وعالم خارجي ونظرا لكثرة الاحتكاك والتعاملات، كان لابد لنا من تناول الآليات الخارجية والدولية خاصة أن المشرع الجزائري تأثر بها، فالمنظمة العالمية للملكية الفكرية ومنظمة التجارة العالمية تعتبران أهم المؤسسات الدولية لحماية الملكية الفكرية، هدفها دعم حقوق الملكية الفكرية في كل أنحاء العالم ويتحقق هذا بتعاون دول العالم وبمساعدة منظمات دولية أخرى عند الاقتضاء، بالإضافة إلى المنظمات الإقليمية والاتحادات المختصة في حماية الملكية الفكرية، وما دورها إلا مكمل للدور الذي تلعبه المنظمات الدولية لحماية هذه الحقوق، وما كل هذه الجهود لحماية الملكية الفكرية إلا لأهمية الموضوع وتأثيره على الاقتصاد العالمي وعلى سياسات الدول. Après l’adhésion de l’Algérie à l’Accord de Paris, elle a créé l’Institut national algérien de la propriété industrielle. les droits moraux, ainsi que l’application de la politique nationale dans ce domaine, Ce mécanisme institutionnel s’est accompagné d’un mécanisme législatif, à savoir la mise en place d’une protection pénale et pénale pour protéger ces droits contre les attaques, afin de fournir un environnement approprié pour l’auteur, le créateur et la créativité intellectuelle afin de se tenir au courant du développement du monde. Mais cela reste insuffisant, car nous vivons au sein d’une communauté internationale et d’un monde extérieur, et en raison du niveau élevé de friction et d’interaction. Nous avons dû faire face à des mécanismes externes et internationaux, d’autant plus que les législateurs algériens en ont été affectés. L’OMPI et l’OMC sont les institutions internationales les plus importantes pour la protection de la propriété intellectuelle visant à faire respecter les droits de propriété intellectuelle dans le monde entier, grâce à la coopération des États du monde et, le cas échéant, avec l’aide d’autres organisations internationales, ainsi que d’organisations et fédérations régionales spécialisées dans la protection de la propriété intellectuelle et dont le rôle n’est que complémentaire du rôle joué par les organisations internationales pour protéger ces droits, Tous ces efforts pour protéger la propriété intellectuelle sont simplement importants et ont un impact sur l’économie mondiale et sur les politiques des États.
