منازعات الأملاك الوطنية في التشريع الجزائري

Abstract

Summary: National property is the assets owned by the state and includes movable and immovable property; national property is divided into public and private. The primary objective of using, managing, and exploiting national property is to achieve public benefit and serve the public interest in terms of public property, while national private property contributes significantly to general revenues. Therefore, the Algerian legislator subjected national property to a strict legal system, especially in the field of management and protection, as well as when ruling on disputes in which the State Property Administration is a party. Jurisdiction falls to the administrative court as a general rule and to the ordinary court as an exception, thereby determining the competent judicial authority. The state is represented before the court through the legal representatives authorized for this purpose at the central, regional, and local levels. Regarding disputes arising from national property belonging to the state, they are numerous and diverse, making it difficult to determine judicial jurisdiction, especially in real estate disputes. .................................. ملخص الأملاك الوطنية هي الممتلكات التي تمتلكها الدولة وتشمل المنقولات والعقارات، وتنقسم الأملاك الوطنية إلى عمومية وخاصة، الهدف الأساسي من استعمال وتسيير الأملاك الوطنية واستغلالها هو تحقيق المنفعة العامة وخدمة الصالح العام بالنسبة للأملاك العمومية أما بالنسبة للأملاك الوطنية الخاصة فتساهم بشكل كبير في الإيرادات العامة، لذلك أخضع المشرع الجزائري الأملاك الوطنية لنظام قانوني محكم، خاصة في مجال التسيير والحماية، وكذا عند الفصل في المنازعات التي تكون إدارة أملاك الدولة طرفًا فيها، فيؤول الاختصاص للقضاء الإداري كأصل عام والقضاء العادي كاستثناء، ومنه تحديد الجهة القضائية المختصة. ويكون تمثيل الدولة أمام القضاء عبر الممثلين القانونيين المخولين لذلك على المستوى المركزي والجهوي والمحلي. أما بخصوص المنازعات الناشئة عن الأملاك الوطنية التابعة للدولة فهي كثيرة ومتنوعة مما يصعب تحديد الاختصاص القضائي خاصة في منازعات العقارية ..................................... Résumé : Le domaine national est l’ensemble des biens appartenant à l’État et comprend les biens meubles et immeubles ; le domaine national se divise en domaine public et domaine privé. L’objectif principal de l’utilisation, de la gestion et de l’exploitation du domaine national est de réaliser l’utilité publique et de servir l’intérêt général en ce qui concerne le domaine public, tandis que le domaine privé national contribue de manière significative aux recettes générales. C’est pourquoi le législateur algérien a soumis le domaine national à un régime juridique strict, notamment en matière de gestion et de protection, ainsi que lors du règlement des litiges dans lesquels l’Administration du domaine de l’État est partie. La compétence juridictionnelle revient, en règle générale, au tribunal administratif et, à titre exceptionnel, au tribunal ordinaire, déterminant ainsi l’autorité judiciaire compétente. L’État est représenté devant le tribunal par les représentants légaux habilités à cet effet aux niveaux central, régional et local. En ce qui concerne les litiges découlant du domaine national appartenant à l’État, ils sont nombreux et divers, ce qui rend difficile la détermination de la compétence judiciaire, en particulier dans les litiges immobiliers.
