المسؤولية الجزائية عن الإستعمال غير القانوني لتقنيات الذكاء الإصطناعي

Abstract

Abstract: This study sheds light on artificial intelligence techniques, beginning by clarifying their nature, defining their concepts and various classifications, while focusing on their strategic applications in the legal and military fields. The study also examines the issue of criminal liability arising from the illegal use of these technologies, determining the legal nature of this liability, its stakeholders, and analyzing the constituent elements of related crimes in light of Algerian legislation and the penalties provided for them. Furthermore, the study reviews the mechanisms of investigation and evidence in crimes committed using artificial intelligence techniques, emphasizing search and investigation mechanisms and the powers of the judicial police, while taking into account the developments and controls established by the Algerian legislature and the Code of Criminal Procedure to address this new type of crime. In conclusion, the study addresses the mechanisms of international cooperation, both security and judicial, to combat these cross-border crimes, highlighting the main problems and challenges that hinder international cooperation, in addition to reviewing ways to overcome them. ............................... الملخص: تتمحور هذه الدراسة حول تسليط الضوء على تقنيات الذكاء الاصطناعي، بدءا من استجلاء ماهيته وضبط مفاهيمه وتصنيفاته المختلفة مع التركيز على تطبيقاته الإستراتيجية في المجالين القانوني والعسكري، كما تبحث الدراسة في إشكالية المسؤولية الجزائية المترتبة عن الاستخدام غير القانوني لهذه التقنيات، وذلك من خلال تحديد الطبيعة القانونية لهذه المسؤولية وأطرافها وتحليل أركان الجرائم المرتبطة بها في ضوء التشريع الجزائري والجزاءات المقررة لها. وعلاوة على ذلك تستعرض الدراسة آليات التحقيق والإثبات في الجرائم المرتكبة باستخدام تقنيات الذكاء الاصطناعي بالتركيز على آليات البحث والتحري وصلاحيات الضبطية القضائية، مع مراعاة المستجدات والضوابط التي أقرها المشرع الجزائري في قانون الإجراءات الجزائية لمواجهة هذا النمط المستحدث من الإجرام. وفي الختام تناولت الدراسة آليات التعاون الدولي الأمني والقضائي لمكافحة هذه الجرائم العابرة للحدود وإبراز أهم الإشكالات والتحديات التي تعيق التعاون الدولي، إضافة إلى استعراض سبل التغلب عليها. ......................... Résumé : Cette étude porte sur la mise en lumière des techniques d’intelligence artificielle, en commençant par clarifier sa nature, définir ses concepts et ses différentes classifications, tout en se concentrant sur ses applications stratégiques dans les domaines juridique et militaire. L’étude examine également la problématique de la responsabilité pénale découlant de l’utilisation illégal de ces technologies et ce en déterminant la nature juridique de cette responsabilité ses parties prenantes et en analysant les éléments constitutifs des crimes qui y sont liés à la lumière de la législation algérienne et des sanctions prévues. De plus l’étude passe en revue les mécanismes d’enquête et de preuve dans les crimes commis à l’aide des techniques d’intelligence artificielle en mettant l’accent sur les mécanismes de recherche et d’investigation et les pouvoir de la police judiciaire tout en tenant compte des développements et des contrôles établis par le législateur algérien le code de procédure pénale pour faire face a ce nouveau type de criminalité. En conclusion l’étude traite des mécanismes de coopération internationale tant sécuritaire que judiciaire pour lutter contre ces crimes transfrontaliers en soulignant les principaux Problèmes et défis qui entravent la coopération internationale, en plus de passer en revue les moyens de les surmonter.
