دور الأجهزة الإدارية في مكافحة الفساد الإداري في التشريع الجزائري

Abstract

ABSTRACT: This study, entitled “The Role of Administrative Bodies in Combating Administrative Corruption in Algerian Legislation,” analyzes the phenomenon of corruption in terms of itsforms, causes, and its impact on the performance of public administration. The studyconcludesthatAlgeria has adopted a legal and institutionalapproach to combating corruption through the ratification of relevant international conventions and the enactment of Law No. 06-01 on the prevention and fightagainst corruption. This framework has been furtherstrengthened by a set of administrative bodies, mostnotably the High Authority for Transparency, Prevention and Fightagainst Corruption, whichperforms a preventiverole by promotingtransparency and fostering a culture of integrity, alongside the Central Office for the Suppression of Corruption, which assumes a repressiverolethrough investigation and inquiryinto corruption offenses and referringthem to the competentjudicialauthorities. The studyalso examines the role of the General Inspectorate of Finance in ensuringprior and accompanying control over the management of public funds and detectingfinancialirregularities, as well as the role of the Court of Accounts in exercising ex-post control and evaluating the effectiveness of financial management within public entities. The studyconcludesthat the Algerian legislator has adopted an integratedinstitutionalframework to combat administrative corruption. However, the effectiveness of these bodies remainsdependent on theirdegree of independence, the availability of human and materialresources, and the level of coordination amongthem. This calls for strengtheningcooperationmechanisms and activatingevaluationtools to ensure tangible results in reducing corruption and consolidating the principles of transparency and integritywithin public administration. ................................. ملخص : تناولت هذه الدراسة الموسومة بدور الأجهزة الإدارية في مكافحة الفساد الإداري في التشريع الجزائري تحليل ظاهرة الفساد من حيث أشكالها و أسبابها و آثارها على آداء الإدارة العمومية ،و توصلت إلى أن الجزائر إعتمدت مقاربة قانونية و مؤسساتية لمكافحة الفساد من خلال المصادقة على الإتفاقيات الدولية ذات الصلة و إصدار القانون رقم 06-01 المتعلق بالوقاية من الفساد و مكافحته كما تم تدعيم هذا الإطار بجملة من الأجهزة الإدارية أبرزهاالسلطة العليا للشفافية والوقاية من الفساد ومكافحته التي تضطلع بوظيفة وقائية تقوم على تعزيز الشفافية وترقية ثقافة النزاهة، إلى جانب الديوان المركزي لقمع الفساد الذي يتكفل بالجانب الردعي من خلال البحث والتحري في جرائم الفساد وإحالتها إلى الجهات القضائية المختصة . كما تناولت الدراسة دور المفتشية العامة للمالية في تكريس الرقابة القبلية والمرافقة لتسيير الأموال العمومية، والكشف عن الاختلالات المالية، فضلاً عن دور مجلس المحاسبة في ممارسة الرقابة البعدية وتقييم فعالية التسيير المالي للهيئات العمومية. وقد خلصت الدراسة إلى أن المشرع الجزائري اعتمد منظومة مؤسساتية متكاملة لمكافحة الفساد الإداري، غير أن فعالية هذه الأجهزة تبقى رهينة بمدى استقلاليتها، وتوفر الموارد البشرية والمادية، وكذا مستوى التنسيق بينها، الأمر الذي يستدعي تعزيز آليات التعاون وتفعيل أدوات التقييم، بما يضمن تحقيق نتائج ملموسة في الحد من الفساد وترسيخ مبادئ الشفافية والنزاهة داخل الإدارة العمومية. .................................. Résumé : Cette étude, intitulée « Le rôle des organes administratifs dans la lutte contre la corruption administrative en droit algérien », a analysé le phénomène de la corruption sous ses différentes formes, ses causes ainsi que ses répercussions sur le fonctionnement de l’administration publique. L’étude a démontré que l’Algérie a adopté une approche à la fois juridique et institutionnelle pour lutter contre la corruption, à travers la ratification des conventions internationales pertinentes et la promulgation de la loi n° 06-01 relative à la prévention et à la lutte contre la corruption. Ce cadre a été renforcé par la mise en place de plusieurs organes administratifs, notamment la Haute Autorité de Transparence, de Prévention et de Lutte contre la Corruption, chargée d’une mission préventive fondée sur la promotion de la transparence et de la culture de l’intégrité, ainsi que l’Office Central de Répression de la Corruption, qui assure le volet répressif à travers la recherche, l’investigation des infractions de corruption et leur transmission aux autorités judiciaires compétentes. L’étude a également examiné le rôle de l’Inspection Générale des Finances dans l’exercice du contrôle préalable et de l’accompagnement de la gestion des deniers publics, ainsi que dans la détection des irrégularités financières. Elle a, en outre, mis en lumière le rôle de la Cour des comptes dans l’exercice du contrôle a posteriori et dans l’évaluation de l’efficacité de la gestion financière des organismes publics. Enfin, l’étude a conclu que le législateur algérien a mis en place un dispositif institutionnel intégré de lutte contre la corruption administrative. Toutefois, l’efficacité de ces organes demeure tributaire de leur degré d’indépendance, de la disponibilité des ressources humaines et matérielles nécessaires, ainsi que du niveau de coordination entre eux. Cela nécessite le renforcement des mécanismes de coopération et l’activation des outils d’évaluation afin de garantir des résultats concrets dans la réduction de la corruption et la consolidation des principes de transparence et d’intégrité au sein de l’administration publique.
