Abstract

Abstract : This thesis addresses the subject of the impact of digital transformation on the performance efficiency of public administration, and seeks to answer a central problematic: Does digital transformation genuinely contribute to enhancing the efficiency of Algerian public administration, and what are the legal controls and practical challenges that surround this path? The study was organized into two main chapters; the first was dedicated to the theoretical framework, where it addressed the concept of digital transformation and its distinction from mere technical digitization, and reviewed the legal foundations established by the Algerian legislator, particularly Law No. 07-18 relating to the protection of personal data and Law No. 04-15 regulating electronic signatures, in addition to analyzing the concept of administrative efficiency and its measurement criteria. As for the second chapter, it was devoted to the applied field aspect, through a case study of the Public Institution of Proximity Health in Souk Ahras, where we observed the tangible effects of digital transformation on the various directorates of the institution, from the management of human and financial resources to the improvement of the patient's electronic medical file pathway, while shedding light on the technical, human, and legislative obstacles that still impede the completion of this transformation. The study concluded that digital transformation represents a strategic necessity rather than a cosmetic option, yet its success is contingent upon the balance between technological power, legal guarantee, and the qualification of the human element. ........................... الملخص: تتناول هذه المذكرة موضوع أثر التحول الرقمي على كفاءة أداء الإدارة العامة، وتسعى إلى الإجابة عن إشكالية محورية مفادها: هل يُسهم التحول الرقمي فعلاً في تعزيز كفاءة الإدارة العامة الجزائرية، وما الضوابط القانونية والتحديات الواقعية التي تكتنف هذا المسار؟ وقد انتظمت الدراسة في فصلين رئيسيين خُصِّص الأول للإطار النظري، إذ تناول مفهوم التحول الرقمي وتمييزه عن الرقمنة التقنية المجردة واستعرض المرتكزات القانونية التي أرساها المشرع الجزائري، لا سيما القانون رقم 07-18 المتعلق بحماية المعطيات الشخصية والقانون رقم 04-15 المنظِّم للتوقيع الإلكتروني، فضلاً عن تحليل مفهوم الكفاءة الإدارية ومعايير قياسها. أما الفصل الثاني فقد انصرف إلى الجانب التطبيقي الميداني، من خلال دراسة حالة المؤسسة العمومية للصحة الجوارية بسوق أهراس، حيث رصدنا الآثار الملموسة للتحول الرقمي على مختلف مديريات المؤسسة، من تسيير الموارد البشرية والمالية إلى تحسين مسار الملف الطبي الإلكتروني للمريض، مع تسليط الضوء على العوائق التقنية والبشرية والتشريعية التي لا تزال تعترض اكتمال هذا التحول. وخلصت الدراسة إلى أن التحول الرقمي يمثّل ضرورة استراتيجية لا خياراً تجميلياً، غير أن نجاحه مشروط بالتوازن بين القوة التكنولوجية والضمانة القانونية وتأهيل العنصر البشري. .............................. Résumé : Ce mémoire traite du sujet de l'impact de la transformation numérique sur l'efficacité des performances de l'administration publique, et cherche à répondre à une problématique centrale : la transformation numérique contribue-t-elle réellement à renforcer l'efficacité de l'administration publique algérienne, et quels sont les contrôles juridiques et les défis pratiques qui entourent cette démarche ? L'étude a été organisée en deux chapitres principaux ; le premier a été consacré au cadre théorique, où il a abordé le concept de transformation numérique et sa distinction de la simple numérisation technique, et a passé en revue les fondements juridiques établis par le législateur algérien, notamment la loi n° 18-07 relative à la protection des données personnelles et la loi n° 15-04 réglementant les signatures électroniques, en plus de l'analyse du concept d'efficacité administrative et de ses critères de mesure. Quant au deuxième chapitre, il a été consacré à l'aspect appliqué et de terrain, à travers une étude de cas de l'Établissement Public de Santé de Proximité de Souk Ahras, où nous avons observé les effets tangibles de la transformation numérique sur les différentes directions de l'établissement, de la gestion des ressources humaines et financières à l'amélioration du parcours du dossier médical électronique du patient, tout en mettant en lumière les obstacles techniques, humains et législatifs qui entravent encore l'achèvement de cette transformation. L'étude a conclu que la transformation numérique représente une nécessité stratégique plutôt qu'une option cosmétique, mais que son succès est conditionné par l'équilibre entre la puissance technologique, la garantie juridique et la qualification de l'élément humain.
