Abstract

Abstract : This study examines the principle of non-impunity in international criminal law as one of the most important principles aimed at ensuring the accountability of perpetrators of serious international crimes and preventing them from going unpunished. The study highlights the development of this principle through international criminal tribunals and the role of the International Criminal Court in enshrining it through the principle of international criminal responsibility. The study also identifies the most prominent challenges hindering its implementation, such as political obstacles and weak international cooperation. It concludes that the effectiveness of this principle requires strengthening international cooperation and supporting international criminal justice to ensure the achievement of justice. .................................. ملخص: تتناول هذه الدراسة مبدأ عدم الإفلات من العقاب في القانون الدولي الجنائي باعتباره أحد أهم المبادئ الهادفة إلى ضمان مساءلة مرتكبي الجرائم الدولية الخطيرة وعدم تركهم دون عقاب وتبرز الدراسة تطور هذا المبدأ من خلال المحاكم الجنائية الدولية ودور المحكمة الجنائية الدولية في تكريسه عبر مبدأ المسؤولية الجنائية الدولية. كما توضح الدراسة أبرز التحديات التي تعيق تطبيقه مثل العوائق السياسية وضعف التعاون الدولي ويخلص إلى أن فاعلية هذا المبدأ تتطلب تعزيز التعاون الدولي ودعم القضاء الجنائي الدولي لضمان تحقيق العدالة. ................................. Résumé : Cette étude examine le principe de non-impunité en droit pénal international, l’un des principes les plus importants visant à garantir la responsabilité des auteurs de crimes internationaux graves et à empêcher qu’ils restent impunis. Elle met en lumière l’évolution de ce principe au sein des tribunaux pénaux internationaux et le rôle de la Cour pénale internationale dans sa consécration par le biais du principe de responsabilité pénale internationale. L’étude identifie également les principaux obstacles à sa mise en œuvre, tels que les freins politiques et la faiblesse de la coopération internationale. Elle conclut que l’efficacité de ce principe requiert un renforcement de la coopération internationale et un soutien accru à la justice pénale internationale afin de garantir que justice soit rendue.
