Abstract

Abstract: This dissertation addresses the issue of the legal protection of juvenile offenders within penal institutions by analyzing the legal and institutional framework governing this category, and by examining the various mechanisms established by the legislator to ensure that juveniles are treated in accordance with their specific age-related and psychological characteristics. It also highlights the shift in modern criminal policy regarding juveniles, moving from a purely punitive approach to a rehabilitative one aimed at correction and social reintegration, while emphasizing the main guarantees and rights granted to them within detention facilities. Furthermore, this study aims to assess the effectiveness of this legal protection in achieving the goals of rehabilitation and re-education, by shedding light on the nature of treatment within penal institutions and its compatibility with legal principles and international conventions related to juvenile rights. The study concludes that the legislator has established a legal framework intended to protect juvenile offenders within these institutions; however, the effectiveness of this framework largely depends on its practical implementation and the availability of appropriate conditions to ensure successful rehabilitation and reintegration. ....................................... ملخص تتناول هذه المذكرة موضوع الحماية القانونية للأحداث الجانحين داخل المؤسسات العقابية من خلال تحليل الإطار القانوني والمؤسساتي المنظم لهذه الفئة، والوقوف على مختلف الاليات التي اقرها المشرع لضمان معاملتهم بما يتناسب مع خصوصيتهم العمرية والنفسية. كما تسعى الى ابراز التحول الذي عرفته السياسة الجنائية الحديثة في التعامل مع الاحداث، من خلال الانتقال من المنظور العقابي التقليدي الى مقاربة اصلاحية تهدف الى التقويم واعادة الادماج، مع التركيز على اهم الضمانات والحقوق المقررة لهم داخل الوسط العقابي. كما تهدف هذه الدراسة الى تقييم مدى فعالية هذه الحماية القانونية في تحقيق اهداف الاصلاح واعادة التأهيل، وذلك من خلال تسليط الضوء على طبيعة المعاملة داخل المؤسسات العقابية ومدى انسجامها مع المبادئ القانونية والمواثيق الدولية المتعلقة بحقوق الاحداث. وقد خلصت الدراسة الى ان المشرع اقر منظومة قانونية تهدف الى حماية الاحداث الجانحين داخل هذه المؤسسات، غير ان تحقيق اهدافها يبقى مرتبطا بمدى التطبيق الفعلي لها وتوفير الظروف الملائمة لضمان نجاح عملية التأهيل والادماج .................................. Résumé : Ce mémoire traite de la question de la protection juridique des mineurs délinquants au sein des établissements pénitentiaires, en analysant le cadre juridique et institutionnel qui régit cette catégorie, ainsi qu’en examinant les différents mécanismes mis en place par le législateur afin de garantir un traitement adapté à leurs spécificités liées à l’âge et à leur développement psychologique. Il met également en évidence l’évolution de la politique criminelle moderne à l’égard des mineurs, marquée par le passage d’une approche essentiellement répressive à une approche axée sur la rééducation, la réhabilitation et la réinsertion sociale, tout en soulignant les principales garanties et les droits qui leur sont reconnus au sein des établissements de détention. Par ailleurs, cette étude vise à évaluer l’efficacité de cette protection juridique dans la réalisation des objectifs de réhabilitation et de rééducation, en mettant en lumière la nature de la prise en charge des mineurs au sein des établissements pénitentiaires ainsi que sa conformité aux principes juridiques et aux conventions internationales relatives aux droits de l’enfant. L’étude conclut que le législateur a instauré un cadre juridique destiné à assurer la protection des mineurs délinquants au sein de ces établissements ; toutefois, l’efficacité de ce dispositif dépend largement de sa mise en œuvre effective ainsi que de la disponibilité des conditions nécessaires pour garantir une réhabilitation et une réinsertion réussies.
