Abstract

Abstract This academic legal study has proventhat the emergence of modern elements of public order is a result of the evolution of the concept of public order as a whole. Undoubtedly, this concept has become one of the contemporary and pressing issues nowadays, especially after witnessing the remarkable development and expansion in variousfields. As a result, new materialelements have emerged, such as the environmental public order, which is closely linked to the urban and esthetic public order, and the economic public order. Additionally, new immaterial (moral) elements have appeared, including public morality, humandignity, and live together(coexistence). Similar to the concept of public order as a whole, these éléments are alsolinked to the foundation suponwhichany society isbuilt in itsvarious aspects. This has prompted the Algerian legislator to keep pace with the development soccurring in various fields in order to preserve these modern elements of public order.These elements have seenvarious applications adopted by the legislator withinits legislative system, as evidencedthrough the exercise of administrative control, whiletaking care not to infringeupon the freedoms and rights of individuals in line with the public interest of the state and society as a whole ......................... الملخص : أثبتت هذه الدراسة القانونية الأكاديمية أن ظهور العناصر الحديثة للنظام العام كان نتيجة تطوّر فكرة النظام العام ككل ومما لاشك فيه أن هذه الفكرة أصبحت من المواضيع الحديثة والملحّة في الوقت الحالي، خصوصا بعد أن عرفت ذلك التطور والتوسع الملحوظ في عديد المجالات المختلفة، فظهرت عناصر حديثة مادية، منها النظام العام البيئي الذي تربطه علاقة وطيدة بالنظام العام العمراني والجمالي والنظام العام الاقتصادي وعناصر حديثة لامادية( معنوي)، منها النظام العام الخلقي( الآداب العامة)، الكرامة الإنسانية، العيش المشترك، كما أن هذه العناصر وعلى غرار فكرة النظام العام ككل نجدها مرتبطة هي أيضا بالأسس التي يُبنى عليها أي مجتمع في مختلف جوانبه، مما دفع بالمشرع الجزائري إلى مواكبة ومسايرة ما يحدث من تطورات حاصلة في عديد المجالات وذلك في سبيل المحافظة على تلك العناصر الحديثة للنظام العام من خلال ممارسة نشاط الضبط الإداري مع مراعاة توخي عدم المساس بحريات الأفراد وحقوقهم بما يتماشى مع المصلحة العامة للدولة والمجتمع ككل. ........................ Résumé Cette étude juridique académique a démontré que l'émergence d'éléments modernes de l'ordre public résulte de l'évolution de la notion d'ordre public dans son ensemble. Il ne fait aucun doute que cette notion est devenue l'un des enjeux contemporains et pressants à l'heure actuelle, notamment après avoir assisté au remarquable développement et à l'expansion dans divers domaines. En conséquence, de nouveaux éléments matériels ont émergé, tels que l'ordre public environnemental, étroitement lié à l'ordre public urbain et esthétique, ainsi que l'ordre public économique. De plus, de nouveaux éléments immatériels (moraux) sont apparus, notamment la moralité publique, la dignité humaine et le vivre ensemble (coexistence). À l'instar de la notion d'ordre public dans son ensemble, ces éléments sont également liés aux fondements sur lesquels repose toute société dans ses différents aspects. Cela a incité le législateur algérien à suivre l'évolution des développements dans divers domaines afin de préserver ces éléments modernes de l'ordre public. Ces éléments ont connu diverses applications adoptées par le législateur au sein de son système législatif, comme en témoigne l'exercice du contrôle administratif, tout en veillant à ne pas porter atteinte aux libertés et aux droits des individus conformément à l'intérêt général de l'État et de la société dans son ensemble.
