Abstract

Abstract :

This study examines the mechanisms of constitutional revision in Algeria, given their central importance in constitutional law and their close connection to the political, legal, and institutional developments experienced by the State. The relevance of this topic stems from the need to strike a balance between preserving constitutional stability and ensuring the flexibility required to adapt to political and social changes. The study is based on the hypothesis that constitutional revision constitutes a constitutional and legal response to various transformations ; however, its exercise must be governed by specific constitutional rules and limitations in order to ensure the continuity and stability of the constitutional system and to safeguard the fundamental principles upon which the State is founded. The study aims to clarify the conceptual framework of constitutional revision, explore its underlying motives and objectives, and trace its historical development in Algeria through successive constitutional texts. It also seeks to distinguish constitutional revision from related constitutional concepts. Furthermore, the study analyzes the mechanisms of constitutional revision within the Algerian context by identifying the authorities empowered to initiate and approve constitutional amendments, as well as examining the different procedural stages involved, from proposal and deliberation to adoption and promulgation. To achieve these objectives, the study is divided into two complementary chapters. The first chapter addresses the conceptual framework of constitutional revision by examining its linguistic and doctrinal definitions, origins, development, forms, and legal foundations. The second chapter focuses on the mechanisms of constitutional revision in Algeria, identifying the competent authorities and the procedures governing the revision process. Particular attention is given to constitutional review, highlighting the role previously exercised by the Constitutional Council and currently assumed by the Constitutional Court in ensuring the constitutionality of proposed amendments. The study concludes that constitutional revision represents a vital instrument for ensuring the continuity of the State and its ability to adapt to evolving circumstances. Nevertheless, its effectiveness depends on strict compliance with the formal and substantive constitutional constraints established by the Constitution. Such compliance guarantees the protection of the fundamental principles of the constitutional order and achieves the necessary balance between constitutional flexibility and the stability of the State. ....................................... الملخص: تبحث هذه الدراسة مسألة آليات التعديل الدستوري في الجزائر، لما تمثله من موضوع جوهري في القانون الدستوري يثير تحديات قانونية وسياسية متعددة. وينبع هذا الاهتمام من ارتباطها الوثيق بمسألة الموازنة بين الحاجة إلى استقرار النص الدستوري، وضرورة استيعابه للتغيرات السياسية والاقتصادية والاجتماعية المتلاحقة التي تشهدها الدولة. تستند الدراسة إلى فرضية مفادها أن التعديل الدستوري يمثل استجابة دستورية وقانونية للتحولات المختلفة، إلا أن ممارسته ينبغي أن تخضع لضوابط وقيود دستورية محددة، وذلك لضمان استمرارية واستقرار النظام الدستوري وصون المبادئ الأساسية التي يقوم عليها كيان الدولة. تستهدف هذه الدراسة توضيح المفهوم الاصطلاحي للتعديل الدستوري، واستكشاف الدوافع والأهداف التي تقف وراءه، فضلاً عن رصد مساره التاريخي في الجزائر عبر الدساتير المتعاقبة. كما تسعى إلى تحديد أشكاله المختلفة، وتمييزه عن المفاهيم الدستورية المتقاربة. تتصدى الدراسة أيضاً لتحليل آليات التعديل الدستوري في السياق الجزائري، وذلك بتحديد الجهات المخولة بإجرائه، كما تبحث في المراحل والإجراءات المتعددة التي يتطلبها، بدءاً من تقديم الاقتراح وانتهاءً بإقراره وإصداره. لتحقيق هذه الأهداف، قُسمت الدراسة إلى فصلين مترابطين. خصّص الفصل الأول لتناول الإطار المفاهيمي للتعديل الدستوري، حيث عُرض فيه مفهومه لغوياً واصطلاحياً، كما بُينت دوافعه وغاياته، فضلاً عن استعراض تطوره التاريخي وأشكاله المتنوعة في الجزائر. بينما خُصص الفصل الثاني لبحث آليات التعديل الدستوري في الجزائر، وذلك بتحديد الجهات المخولة بإجرائه، والمراحل التي يمر بها هذا التعديل. كما تناول بالدراسة الرقابة القضائية المفروضة عليه، مع التركيز على الدور الذي اضطلع به المجلس الدستوري سابقاً، وتضطلع به المحكمة الدستورية حالياً، في التحقق من دستورية التعديلات المقترحة. في الختام، توصلت الدراسة إلى أن التعديل الدستوري يشكل أداة حيوية لضمان استمرارية كيان الدولة وقدرتها على التكيف مع التحولات المتنوعة. إلا أن مدى فاعليته يرتبط بمدى التقيد بالضوابط الشكلية والموضوعية التي يفرضها الدستور، وهذا يكفل صون المبادئ الجوهرية للنظام الدستوري، ويحقق التوازن المنشود بين مرونة الدستور وثبات الدولة. .................................... Résumé : La présente étude se consacre à l'analyse de la révision constitutionnelle, appréhendée comme un mécanisme juridique et politique essentiel. Elle permet d'ajuster la Constitution aux transformations de l'État et de la société, tout en s'efforçant de maintenir la stabilité de l'ordre constitutionnel et la pérennité des institutions étatiques. Initialement, une délimitation conceptuelle de la révision constitutionnelle sera proposée, tant sur le plan linguistique que doctrinal. Elle sera suivie d'une explication de ses fondements et finalités, en soulignant son rôle d'instrument d'équilibre entre la rigidité intrinsèque d'une constitution et l'impératif de son adaptation. Une section sera également consacrée à l'examen de l'évolution historique de la révision constitutionnelle en Algérie. Cet examen se fera au prisme des diverses Constitutions algériennes, avec une attention particulière portée aux textes de 1963, 1976, 1989 et 1996, ainsi qu'aux modifications constitutionnelles subséquentes. Parallèlement, une typologie des formes de révision sera présentée, en les distinguant clairement des concepts juridiques afférents. Par ailleurs, l'étude s'intéressera aux modalités procédurales de la révision constitutionnelle propres au contexte algérien. Il s'agira d'identifier les instances habilitées à initier une telle révision, à savoir principalement le Président de la République et le Parlement. En outre, les différentes phases de cette procédure, de l'initiative à l'approbation et la promulgation du texte révisé, seront méthodiquement décrites. En outre, une partie significative sera consacrée au contrôle juridictionnel de la révision constitutionnelle. Ce contrôle est fondamental pour garantir l'observance des stipulations constitutionnelles ainsi que des contraintes formelles et matérielles inhérentes à toute modification. Dans cette perspective, l'analyse portera sur l'évolution du rôle des instances chargées de ce contrôle de constitutionnalité, examinant successivement la fonction exercée par l'ancien Conseil constitutionnel et celle assumée aujourd'hui par la Cour constitutionnelle. Pour conclure, cette recherche établit que la révision constitutionnelle, bien que s'imposant comme une exigence face aux mutations politiques, économiques et sociales, doit impérativement s'inscrire dans le respect des normes et des limites fixées par la Constitution elle-même. Cette circonspection est indispensable à la préservation de la stabilité étatique et à la sauvegarde des principes fondamentaux qui sous-tendent l'ordre constitutionnel.
