Abstract

Summary : This study examines Hybrid Criminal Tribunals as a modern judicial mechanism designed to address the shortcomings of traditional systems in tackling grave human rights violations. The research analyzes the nature of these courts, which blend national and international elements, focusing on their diverse application models: from those established by bilateral agreements Sierra Leone and Lebanon , to those based on international assistance East Timor and Cambodia. And highlighting the effectiveness of this hybrid model in ending impunity and advancing international criminal justice in line with the specific needs of conflict-affected states. .............................. ملخص المذكرة : تتناول هذه الدراسة المحاكم الجنائية الهجينة كآلية قضائية مستحدثة لمواجهة قصور الأنظمة التقليدية في التصدي للانتهاكات الجسيمة لحقوق الإنسان. فتهدف المذكرة إلى تحليل طبيعة هذه المحاكم التي تمزج بين العناصر الوطنية والدولية، مع التركيز على نماذجها التطبيقية المختلفة؛ بدءا من المحاكم المنشأة بموجب اتفاقات ثنائية كما في حالتي سيراليون ولبنان ، وصولا إلى المحاكم القائمة على إطار المساعدة الدولية كما في تيمور الشرقية وكمبوديا. مع إبراز فاعلية هذا النمط الهجين في كسر حاجز الإفلات من العقاب وتطوير العدالة الجنائية الدولية بما يتلاءم مع خصوصيات الدول المتضررة. ............................... Résumé Cette étude examine les tribunaux pénaux hybrides en tant que mécanisme judiciaire moderne, conçu pour pallier les insuffisances des systèmes traditionnels face aux violations graves des droits de l'homme. La recherche analyse la nature de ces juridictions qui mêlent des éléments nationaux et internationaux, en se concentrant sur leurs différents modèles d'application : depuis ceux établis par des accords bilatéraux (comme en Sierra Leone et au Liban), jusqu'à ceux basés sur un cadre d'assistance internationale (comme au Timor oriental et au Cambodge). L'étude met également en évidence l'efficacité de ce modèle hybride pour briser le cercle de l'impunité et développer la justice pénale internationale, de manière à l'adapter aux spécificités des États touchés.
