Abstract

Abstract : The study aimed to examine the conceptual and legal framework governing freedom of opinion and expression as a fundamental human right, as well as the restrictions imposed on this right, given that its arbitrary exercise may turn into hate speech criminalized under international conventions and national legislation. The research also addressed the legal challenges in protecting freedom of opinion, the negative impacts resulting from hate speech, and the legal and institutional mechanisms designed to achieve a balance between safeguarding freedom of expression on the one hand and criminalizing hate speech on the other. It further explored international and national preventive mechanisms and procedures to limit the spread of hate speech. Thus, the study seeks to achieve a precise balance between the right to freedom of expression as one of the fundamental human rights and the protection of society and public order from hate speech in its various forms and manifestations. ................................ الملخص: استهدفت الدراسة الوقوف على الإطار المفاهيمي والقانوني المحدد لحرية الرأي والتعبير باعتباره حق أساسي من حقوق الانسان والقيود المفروضة على هذا الحق باعتبار أن ممارسته بصورة تعسفية تتحول إلى خطاب للكراهية المجرم في المواثيق الدولية والتشريعات الوطنية. كما تناول البحث التحديات القانونية في حماية حرية الرأي والأثار السلبية الناتجة عن خطاب الكراهية، وكذا الأليات القانونية والمؤسساتية لتحقيق التوازن بين حماية حرية التعبير من جهة وبين تجريم خطاب الكراهية من جهة أخرى، والأليات والإجراءات الوقائية الدولية والوطنية من أجل الحد من انتشار خطاب الكراهية. وبذلك يسعى البحث لتحقيق توازن دقيق بين الحق في حرية التعبير كأحد الحقوق الأساسية من حقوق الانسان وبين حماية المجتمع والنظام العام من خطاب الكراهية بمختلف أشكاله وأنماطه .................................... Résumé : L’étude a visé à mettre en évidence le cadre conceptuel et juridique définissant la liberté d’opinion et d’expression en tant que droit fondamental des droits de l’homme, ainsi que les restrictions imposées à ce droit, considérant que son exercice abusif se transforme en discours de haine incriminé par les instruments internationaux et les législations nationales. La recherche a également abordé les défis juridiques liés à la protection de la liberté d’opinion, les effets négatifs résultant du discours de haine, ainsi que les mécanismes juridiques et institutionnels permettant de réaliser un équilibre entre la protection de la liberté d’expression d’une part et la criminalisation du discours de haine d’autre part, en plus des mécanismes et procédures préventifs internationaux et nationaux visant à limiter la propagation du discours de haine. Ainsi, l’étude cherche à atteindre un équilibre précis entre le droit à la liberté d’expression, en tant que l’un des droits fondamentaux de l’homme, et la protection de la société et de l’ordre public contre le discours de haine sous ses diverses formes et manifestations..
