نظام الرقابة على العملية الإنتخابية في التشريع الجزائري

Abstract

Abstract Electoral oversight stands as one of the most prominent guarantees enshrined by modern democratic systems to preserve the integrity of electoral processes and protect popular will from all forms of manipulation and deviation. Elections, as the fundamental mechanism for the peaceful transfer of power, require a robust legal and organizational framework that governs their course and ensures their integrity, from the candidacy stage through to the official announcement of results. In this context, the oversight system in its various forms, whether judicial, administrative, or civil society-based, emerges as the true guarantor of voter freedom and ballot transparency. However, the effectiveness of such oversight can only be achieved through the independence of supervising bodies and the integrity of those entrusted with this responsibility, for oversight without autonomy holds no value, and elections without transparency hold no meaning. Accordingly, electoral oversight remains an indispensable pillar in building a state governed by the rule of law and consolidating genuine democratic practice. ................................... الملخص: تُعدّ الرقابة على العملية الانتخابية من أبرز الضمانات التي كرّستها الأنظمة الديمقراطية الحديثة لصون نزاهة الاستحقاقات الانتخابية وحماية الإرادة الشعبية من كل أشكال التلاعب والانحراف. فالانتخابات بوصفها الآلية الأساسية للتداول السلمي على السلطة، تستوجب إطاراً قانونياً وتنظيمياً محكماً يضبط مساراتها ويكفل سلامتها، من مرحلة الترشح وصولاً إلى الإعلان الرسمي عن النتائج. وفي هذا السياق تبرز منظومة الرقابة بأنواعها المتعددة، قضائية كانت أم إدارية أم مجتمعية، باعتبارها الضامن الحقيقي لحرية الناخب وشفافية الاقتراع. غير أن فاعلية هذه الرقابة لا تتحقق إلا باستقلالية الهيئات المشرفة عليها ونزاهة القائمين بها، إذ لا قيمة لرقابة مقيّدة ولا معنى لانتخابات تفتقر إلى الشفافية. وعليه، تبقى الرقابة على العملية الانتخابية ركيزة لا غنى عنها في بناء دولة القانون وترسيخ الممارسة الديمقراطية الحقيقية. ..................................... Résumé Le contrôle du processus électoral constitue l'une des garanties fondamentales consacrées par les systèmes démocratiques modernes afin de préserver l'intégrité des élections et de protéger la volonté populaire contre toute forme de fraude ou de manipulation. Les élections, en tant que mécanisme essentiel de l'alternance pacifique au pouvoir, nécessitent un cadre juridique et organisationnel rigoureux régissant l'ensemble de leurs étapes, depuis le dépôt des candidatures jusqu'à la proclamation officielle des résultats. Dans ce contexte, les différentes formes de contrôle, qu'elles soient juridictionnelles, administratives ou exercées par la société civile, représentent une garantie essentielle de la liberté des électeurs et de la transparence du scrutin. Toutefois, l'efficacité de ce contrôle demeure étroitement liée à l'indépendance des organes chargés de sa mise en œuvre ainsi qu'à l'intégrité de leurs membres. Ainsi, le contrôle du processus électoral reste un pilier indispensable à la consolidation de l'État de droit et au renforcement d'une véritable pratique démocratique.
