الظروف الإستثنائية وأثرها على الحريات العامة في الجزائر

Abstract

Abstract This study examines the impact of exceptional circumstances on the exercise of public freedoms in Algeria under the Constitutional Amendment of 2020. It analyzes the various exceptional regimes granted to the President of the Republic, including the state of emergency, state of siege, exceptional state, general mobilisation, and state of war. The study aims to highlight the extent to which these exceptional situations affect fundamental rights and public freedoms, while clarifying the constitutional and legal safeguards established to prevent abuse of power. The research relied on both descriptive and analytical approaches through the examination of constitutional and legal texts as well as relevant doctrinal opinions. The study concluded that the Algerian constitutional legislator sought to achieve a balance between preserving state security and ensuring the continuity of public institutions on the one hand, and protecting public freedoms on the other hand, by subjecting exceptional powers to several substantive, procedural, and supervisory constraints. However, the expansion of the discretionary powers of the President during exceptional circumstances may lead to restrictions on public freedoms, which requires strengthening judicial and parliamentary oversight to ensure the protection of constitutionally guaranteed rights and freedoms. ................................ الملخص تتناول هذه الدراسة موضوع أثر الحالات الاستثنائية على ممارسة الحريات العامة في الجزائر في ظل التعديل الدستوري لسنة 2020، وذلك من خلال تحليل مختلف الأنظمة الاستثنائية التي خولها الدستور لرئيس الجمهورية، والمتمثلة في حالة الطوارئ، حالة الحصار، الحالة الاستثنائية، حالة التعبئة العامة، وحالة الحرب. وقد هدفت الدراسة إلى إبراز مدى تأثير هذه الحالات على الحقوق والحريات العامة، مع بيان الضمانات الدستورية والقانونية المقررة لحمايتها من التعسف والانحراف في استعمال السلطة. واعتمدت الدراسة على المنهج الوصفي والتحليلي من خلال تحليل النصوص الدستورية والتشريعية والآراء الفقهية ذات الصلة. وتوصلت الدراسة إلى أن المؤسس الدستوري الجزائري حاول تحقيق نوع من التوازن بين متطلبات المحافظة على أمن الدولة واستمرارية مؤسساتها من جهة، وضمان احترام الحقوق والحريات العامة من جهة أخرى، وذلك عبر إخضاع السلطات الاستثنائية لجملة من القيود الموضوعية والشكلية والرقابية. غير أن اتساع السلطة التقديرية لرئيس الجمهورية أثناء الظروف الاستثنائية قد يفتح المجال أمام تقييد بعض الحريات العامة، الأمر الذي يستوجب تعزيز الرقابة القضائية والبرلمانية لضمان عدم المساس بجوهر الحقوق والحريات المكفولة دستورياً. .................................. Résumé Cette étude porte sur l’impact des situations exceptionnelles sur l’exercice des libertés publiques en Algérie à la lumière de la révision constitutionnelle de 2020. Elle analyse les différents régimes exceptionnels accordés au Président de la République, notamment l’état d’urgence, l’état de siège, l’état exceptionnel, la mobilisation générale et l’état de guerre. L’étude vise à mettre en évidence l’influence de ces situations sur les droits et libertés fondamentales, tout en exposant les garanties constitutionnelles et juridiques destinées à prévenir les abus de pouvoir. La recherche s’est appuyée sur les méthodes descriptive et analytique à travers l’analyse des textes constitutionnels, législatifs ainsi que des opinions doctrinales pertinentes. Les résultats démontrent que le constituant algérien a tenté d’établir un équilibre entre la nécessité de préserver la sécurité de l’État et la continuité des institutions publiques d’une part, et la protection des libertés publiques d’autre part, en soumettant les pouvoirs exceptionnels à plusieurs contraintes juridiques et mécanismes de contrôle. Toutefois, l’élargissement du pouvoir discrétionnaire du Président de la République en période exceptionnelle peut conduire à une restriction des libertés publiques, ce qui nécessite le renforcement du contrôle juridictionnel et parlementaire afin de garantir la protection des droits et libertés consacrés par la Constitution.
