Abstract

Summary The Algerian legislator enacted Law No. 10-03 dated August 15, 2010, which includes the conditions and procedures for exploiting agricultural lands belonging to the lands through a fixed-term concession contract for a period of 40 years, renewable. The permanent usufruct right stipulated by the repealed Law 87-19 was transformed into a concession right, which grants the investor who meets the set of conditions the right to exploit the agricultural investment under the supervision of regulatory bodies in return for the payment of an annual fee. Through this law, the legislator worked to protect unexploited agricultural lands. .................................. ملخــــــص أوجد المشرع الجزائري القانون رقم 10-03 المؤرخ في 15 غشت 2010 الذي يتضمن شروط وكيفيات استغلال الأراضي الفلاحية التابعة الأراضي عن طريق عقد امتياز محدد المدة لمدة 40 سنة قابلة للتجديد، حيث تم تحول حق الانتفاع الدائم المنصوص عليه بموجب قانون 87-19 الملغى إلى حق الامتياز والذي يمنح للمستثمر الذي تتوفر فيه مجموعة الشروط الحق في استغلال المستثمرة الفلاحية تحت رقابة هيئات رقابية مقابل دفع أتاوة سنوية، حيث عمل المشرع من خلال هذا القانون حماية الأراضي الفلاحية الغير مستغلة. ................................. Résumé Le législateur Algérien promulgua la loi n° 10-03 du: 15 Aout 2010 dans laquelle il énumère les conditions et les procédures liées à l’exploitation des terres agricoles du domaine privé de l’Etat, à travers le contrat de concession ‘’concessions agricoles’’ affectées au secteur privé sujet de droit privé. Ces concessions agricoles devront se soumettre et au contrôle et à l’accompagnement des autorité administratives compétentes qui veillent à l’exploitation modelé et optimale des terres agricoles biens de l’ETAT .
