حماية الإستثمار في التشريع الجزائري

Abstract

Abstract : This study aimed to examine the effectiveness of the legal protection of investment in Algerian legislation through analyzing the various guarantees and mechanisms established by the legislator in order to provide a safe and encouraging legal environment for investors, whether national or foreign. It also sought to highlight the role played by these guarantees in enhancing confidence and achieving economic stability, while addressing the most important legal reforms introduced in the field of investment in Algeria, as well as identifying the shortcomings and challenges that may affect the effectiveness of investment protection. The study concluded that the Algerian legislator has worked to establish several legal guarantees for the protection of investment, through the constitutionalization of the freedom of investment, ensuring equality between investors, protecting private property, prohibiting expropriation except under legal conditions, and providing mechanisms for the settlement of investment disputes. However, the effectiveness of these guarantees remains dependent on the stability of legislation, the simplification of administrative procedures, and the improvement of the business climate in a way that ensures legal and economic security for investors. ...................................... الملخص : هدفت هذه الدراسة إلى معرفة مدى فعالية الحماية القانونية للاستثمار في التشريع الجزائري، من خلال تحليل مختلف الضمانات والآليات التي أقرها المشرّع من أجل توفير بيئة قانونية آمنة ومحفزة للمستثمرين، سواء كانوا وطنيين أو أجانب، كما يسعى إلى إبراز الدور الذي تلعبه هذه الضمانات في تعزيز الثقة وتحقيق الاستقرار الاقتصادي، مع التطرق إلى أهم الإصلاحات القانونية التي عرفها مجال الاستثمار في الجزائر، وبيان النقائص والتحديات التي قد تؤثر على فعالية حماية الاستثمار. وتوصلت الدراسة إلى أن المشرّع الجزائري عمل على تكريس عدة ضمانات قانونية لحماية الاستثمار، من خلال دسترة حرية الاستثمار، وضمان المساواة بين المستثمرين، وحماية الملكية الخاصة، ومنع نزع الملكية إلا وفق الشروط القانونية، إضافة إلى توفير آليات لتسوية منازعات الاستثمار، غير أن فعالية هذه الضمانات تبقى مرتبطة بمدى استقرار التشريع وتبسيط الإجراءات الإدارية وتحسين مناخ الأعمال بما يحقق الأمن القانوني والاقتصادي للمستثمر. ....................................... Résumé : Cette étude vise à examiner l’efficacité de la protection juridique de l’investissement dans la législation algérienne à travers l’analyse des différentes garanties et mécanismes mis en place par le législateur afin d’offrir un environnement juridique sûr et attractif aux investisseurs, qu’ils soient nationaux ou étrangers. Elle met également en lumière le rôle de ces garanties dans le renforcement de la confiance et la réalisation de la stabilité économique, tout en abordant les principales réformes juridiques introduites dans le domaine de l’investissement en Algérie, ainsi que les insuffisances et les défis susceptibles d’affecter l’efficacité de la protection de l’investissement. L’étude a conclu que le législateur algérien a œuvré à l’instauration de plusieurs garanties juridiques en faveur de la protection de l’investissement, notamment par la consécration constitutionnelle de la liberté d’investissement, l’assurance de l’égalité entre les investisseurs, la protection de la propriété privée, l’interdiction de l’expropriation en dehors des conditions prévues par la loi, ainsi que la mise en place de mécanismes de règlement des différends liés à l’investissement. Toutefois, l’efficacité de ces garanties demeure tributaire de la stabilité du cadre législatif, de la simplification des procédures administratives et de l’amélioration du climat des affaires, de manière à garantir la sécurité juridique et économique des investisseurs.
