Abstract

Abstract: This study aimed to clarify how artificial intelligence (AI) impacts civil liability, analyzing the adequacy of traditional civil liability rules (foundations) to address damages resulting from AI systems. To achieve these objectives, we employed a descriptive approach by clarifying the nature of AI, its applications, its legal status, and the types of civil liability. We also utilized an analytical approach, particularly in analyzing civil law texts related to civil liability. This study concluded with several key findings, most notably that AI's impact on the theory of civil liability is evident. This is demonstrated by the ineffectiveness of traditional rules in covering the risks and damages resulting from the use of AI technologies. Consequently, legal scholars and the judiciary sought modern foundations for civil liability that would facilitate compensation for those harmed. The element of fault was abandoned as a fundamental component of liability, and the focus shifted to the element of harm. The principles of precaution and liability for defective products were also adopted, which resonated with the public. This approach has led to the adoption of modern foundations for civil liability that keep pace with technological advancements and the emergence of these new technologies, which are incompatible with traditional foundations. ...................................... ملخص هدفت هذه الدراسة إلى توضيح كيفية تأثير الذكاء الاصطناعي على المسؤولية المدنية، مع تحليل مدى كفاية القواعد(الأسس) التقليدية للمسؤولية المدنية لمعالجة الأضرار الناتجة عن أنظمة الذكاء الاصطناعي، ولتحقيق هذه الأهداف استخدمنا المنهج الوصفي وذلك من خلال توضيح ماهية الذكاء الاصطناعي وتطبيقاته ومركزه القانوني والاسس التقليدية والحديثة التي تقوم عليها المسؤولية المدنية، وكذا المنهج التحليلي خاصة عند تحليل نصوص القانون المدني المتعلقة بالمسؤولية المدنية. وقد خلصت هذه الدراسة إلى مجموعة من النتائج أهمها أن تأثير الذكاء الاصطناعي كان واضحا على نظرية المسؤولية المدنية ويتجلى ذلك في عدم نجاعة القواعد التقليدية في تغطية الأخطار والأضرار الناتجة عن استخدام تقنيات الذكاء الاصطناعي، مما جعل الفقه والقضاء يبحث عن أسس حديثة للمسؤولية المدنية تسهل على المتضرر الحصول على تعويض، فتم الاستغناء عن الخطأ كركن أساسي للمسؤولية وتم التركيز على ركن الضرر، والاعتماد على مبدا الحيطة والمسؤولية عن المنتج المعيب هذاما وجد صدى في تبرير المسؤولية والحصول على تعويض عادل وبالتالي تم الاعتماد علي أسس حديثة للمسؤولية المدنية مواكبة للتطور التكنولوجي وظهور هذه التقنيات الحديثة التي لا تتماش مع الأسس التقليدية. ............................... Cette étude vise à clarifier l'impact de l'intelligence artificielle (IA) sur la responsabilité civile, en analysant la pertinence des règles traditionnelles de responsabilité civile (fondements) pour traiter les dommages résultant des systèmes d'IA. Pour ce faire, nous avons adopté une approche descriptive en précisant la nature de l'IA, ses applications, son statut juridique et les types de responsabilité civile. Nous avons également utilisé une approche analytique, notamment en analysant les textes de droit civil relatifs à la responsabilité civile.

Cette étude a permis de dégager plusieurs conclusions importantes, notamment l'impact manifeste de l'IA sur la théorie de la responsabilité civile. Cet impact est démontré par l'inefficacité des règles traditionnelles pour couvrir les risques et les dommages résultant de l'utilisation des technologies d'IA. En conséquence, les juristes et les magistrats ont recherché des fondements modernes de la responsabilité civile qui faciliteraient l'indemnisation des victimes. La notion de faute a été abandonnée en tant qu'élément fondamental de la responsabilité, et l'accent a été mis sur la notion de préjudice. Les principes de précaution et de responsabilité du fait des produits défectueux ont également été adoptés, ce qui a trouvé un écho favorable auprès du public. Cette approche a conduit à l'adoption de fondements modernes en matière de responsabilité civile, adaptés aux progrès technologiques et à l'émergence de ces nouvelles technologies, incompatibles avec les fondements traditionnels.
