الهيئات المشرفة على الإستثمار في القانون رقم 22-18

Abstract

Summary : In recent years, the investment sector in Algeria has received increasing attention as one of the fundamental drivers of the national economy. In this context, the Algerian legislator has worked to modernize the legal system through the issuance of Law No. 22-18, which introduced reforms aimed at creating an attractive environment for both national and foreign investments. This study examines the bodies responsible for overseeing and supervising investment, particularly the National Investment Council, which is responsible for defining the general policy for investment. The council has undergone modifications in terms of its membership composition as well as its functions, which have been reduced and limited to the strategic aspect only. Consequently, the project portfolio was transferred to the Algerian Investment Promotion Agency, being the second oversight body for investment. Formerly known as the National Agency for Investment Development, it was tasked with the mission of materializing investment projects on the ground as the executive authority empowered to support the investor throughout the various stages of project implementation through its "single-window" systems. This comes with the creation of new powers related to the digitalization of administrative procedures required by the investor via the digital platform and the monitoring of project execution, the legislator also strengethened investor protection through the establishment of the national high commission for appeals as a mechanism for examining appeals related to investment. ............................. الملخص: حظي قطاع الاستثمار في الجزائر باهتمام متزايد في السنوات الأخيرة باعتباره أحد المحركات الأساسية للاقتصاد الوطني، وفي هذا الاطار عمل المشرع الجزائري على تحديث المنظومة القانونية من خلال اصدار القانون رقم 22- 18 الذي جاء بإصلاحات تهدف الى تهيئة بيئة جاذبة للاستثمارات الوطنية والاجنبية ،وقد تناولت هذه الدراسة الهيئات المكلفة بالتأطير والاشراف على الاستثمار لاسيما المجلس الوطني للاستثمار الذي يتولى مهام رسم معالم السياسة العامة للاستثمار ،والذي شهد تعديلات من ناحية تركيبته العضوية وكذا من ناحية مهامه التي قلصت واقتصرت على الجانب الاستراتيجي فقط وقد تم تحويل حافظة المشاريع للوكالة الجزائرية لترقية الاستثمار لكونها الهيئة الثانية المشرفة على الاستثمار والتي كانت تدعى سابقا بالوكالة الوطنية لتطوير الاستثمار تاركا لها مهمة تجسيد المشاريع الاستثمارية على ارض الواقع باعتبارها الجهة التنفيذية المخولة بمرافقة المستثمر طيلة فترات انجاز مشروعه عبر مختلف شبابيكها الوحيدة، مع استحداث صلاحيات جديدة تتمثل في رقمنة الإجراءات الإدارية التي يحتاجها المستثمر عبر المنصة الرقمية ومتابعة تنفيذ المشاريع، كما عزز المشرع حماية المستثمر من خلال استحداث اللجنة الوطنية العليا للطعون كألية للنظر في الطعون المرتبطة بالاستثمار. ............................ Résumé : Ces dernières années, le secteur de l’investissement en Algérie a suscité un intérêt croissant en tant que l’un des principaux moteurs de l’économie nationale. Dans ce contexte, le législateur algérien a œuvré à la modernisation du cadre juridique à travers la promulgation de la loi n° 22-18, qui a introduit plusieurs réformes visant à instaurer un environnement attractif pour les investissements nationaux et étrangers Cette étude examine les organismes chargés de l’encadrement et du contrôle de l’investissement, notamment le Conseil National de l’Investissement, chargé de définir la politique générale de l’investissement. Ce conseil a connu des modifications concernant sa composition ainsi que ses attributions, désormais réduites et limitées au seul aspect stratégie Par conséquent, le portefeuille des projets d’investissement a été transféré à l’Agence Algérienne de Promotion de l’Investissement, deuxième organe de supervision de l’investissement. Anciennement dénommée Agence Nationale de Développement de l’Investissement, cette institution est chargée de concrétiser les projets d’investissement sur le terrain en tant qu’autorité exécutive habilitée à accompagner l’investisseur à travers les différentes étapes de réalisation du projet grâce à ses guichets uniques Par ailleurs, de nouvelles prérogatives lui ont été attribuées, notamment en matière de numérisation des procédures administratives nécessaires aux investisseurs via la plateforme numérique, ainsi que dans le suivi de l’exécution des projets. Le législateur a également renforcé la protection des investisseurs par la création de la Haute Commission Nationale des Recours, chargée de l’examen des recours liés à l’investissement.
