Abstract:
The role of the Council of State has been strengthened and its jurisdiction reorganized following the amendment of the law by Law No. 13-22, which introduced significant reforms establishing the principle of a two-tier litigation system. This resulted in reinforcing the role of the Council of State and restructuring its competence, so that the latter now acts as a body that reviews the judgments and judicial decisions issued by the newly established judicial bodies and the administrative court. Likewise, it is tasked with the appellate function for decisions issued by all administrative bodies specified by law. This appellate mission follows the establishment of the Administrative Court of Appeal in Algiers, which reduced the burden on the Council of State, allowing it to dedicate itself truly to its actual mission as a court of law (and jurisprudence), and to enrich the legal system with its precedents required to address the legislative vacuum.

الملخص
تم تعزيز دور مجلس الدولة وإعادة تنظيم اختصاصه بعد تعديل قانون 22/13، الذي أحدث إصلاحات هامة مكرسا مبدأ التقاضي على درجتين مما ترتب عنه تعزيز دور مجلس الدولة وإعادة تنظيم اختصاصه، فأصبح هذا الأخير يمارس دورا كجهة نقض في الأحكام والقرارات النهائية الصادرة عن الجهات القضائية المستحدثة والمحكمة الإدارية، وكل الجهات الإدارية التي نص القانون عليها، وليطلع بمهمة الاستئناف، بعد ما تم إنشاء المحكمة الإدارية الإستئنافية بالجزائر العاصمة، وهذا ما خفف العبء على مجلس الدولة ليتفرغ إلى حقيقة إنشائه كـمحكمة قانون و بحقق المنظومة القانونية باجتهاداته التي يحتاجها الفراغ التشريعي.

Résumé :
Le rôle du Conseil d'État a été renforcé et ses compétences ont été réorganisées suite à la modification de la loi par la loi n° 22-13, qui a introduit d'importantes réformes consacrant le principe du double degré de juridiction. Cela a permis de consolider le rôle du Conseil d'État et de restructurer ses attributions, de sorte que ce dernier exerce désormais une fonction de contrôle des jugements et des arrêts rendus par les juridictions nouvellement créées et le tribunal administratif. De plus, il est chargé de statuer en appel sur les décisions rendues par l'ensemble des autorités administratives prévues par la loi. Cette mission d'appel intervient après la création de la Cour administrative d'appel d'Alger, ce qui a allégé la charge du Conseil d'État, lui permettant de se consacrer pleinement à sa véritable mission de juge du droit (et de jurisprudence), et d'enrichir le système juridique par ses arrêts afin de combler le vide législatif.
