Abstract

يهدف هذا المقال إلى تسليط الضوء على عقد الإيجار كوجه لتفويض المرفق العام في الجزائر، وذلك من خلال محاولة التعرف على مفهومه وأهم خصائصه وعلى أوجه التشابه والاختلاف بينه وبين عقود تفويض المرفق العام الأخرى (الامتياز، الوكالة المحفزة، التسيير)، فعلى الرغم من المزايا التي يحققها الإيجار في هذا المجال، إلا أنه وحتى وقت قريب لم يحظ بالاهتمام الكافي من قبل المشرع الجزائري إلى أنْ جاء المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام الذي كرس لعقد الإيجار صراحة كشكل من أشكال تفويض المرفق العام.
