الأليات المؤسساتية لمكافحة الجريمة الإلكترونية في التشريع الجزائري

Abstract

Abstract: This study aims to examine the Algerian legislator’s approach to cybercrime as one of the most dangerous challenges faced by the modern legal system, especially due to its transnational nature and the development of its technical methods. By highlighting deterrent legal rules, the Algerian legislator established a specialized institutional structure aimed at preventing, limiting, and suppressing these cybercrimes. These institutional mechanisms revolved around a combination of judicial and security bodies working to confront cyber threats. .............................. ملخص: تهدف هذه الدراسة بتناول المشرع الجزائري للجريمة الإلكترونية كونها من أخطر التحديات التي تعرضت إليها المنظومة القانونية الحديثة، خاصة طبيعتها العابرة للحدود والتطور الذي شملته أساليبها التقنية. من خلال تسليط المشرع الجزائري الضوء على القواعد القانونية الردعية وأوجد هيكلة مؤسساتية متخصصة غايتها الوقاية من هذه الجرائم المعلوماتية والحد منها وقمعها، فتمحورت هذه الآليات المؤسساتية حول خليط من هيئات قضائية وأخرى أمنية تعمل على مواجهة التهديدات السيبرانية. ........................... Résumé : Cette étude vise à examiner l’approche adoptée par le législateur algérien face à la cybercriminalité, considérée comme l’un des défis les plus dangereux auxquels est confronté le système juridique moderne, notamment en raison de son caractère transnational et du développement de ses méthodes techniques. En mettant en place des règles juridiques dissuasives, le législateur algérien a instauré une structure institutionnelle spécialisée ayant pour objectif de prévenir, limiter et réprimer ces cybercrimes. Ces mécanismes institutionnels reposent sur un ensemble d’organes judiciaires et sécuritaires œuvrant à faire face aux menaces cybernétiques.
