Abstract

summary Due to the escalating phenomenon of encroachment on national property, particularly state-owned land, the Algerian legislature has enacted laws and decrees to curb this unjust practice against public property. These measures range from preliminary administrative procedures to subsequent actions, culminating in Law 23-18. This law includes deterrent penalties for anyone who dares to encroach on state land. It represents a new legislative framework specifically designed to protect and preserve state land from all forms of encroachment, unlike Law 15-08, which aimed to regularize illegal constructions. Law 23-18 is a deterrent and protective law that establishes strict measures against any encroachment on public property The enactment of Law 23-21 concerning forests and forest resources introduced several penalties, ranging up to life imprisonment, commensurate with the extent of the damage. It also established punitive measures against any negligence on the part of forest visitors and the potential dangers their actions pose to the forest and the spread of fires, given the fires that have plagued Algeria in recent years and the resulting material and human losses. Keywords: National property, Law 23-18, Real estate, Law 18-23, Law 23-21.. .................................. ملخص نظرا لاستفحال ظاهرة التعدي على الاملاك الوطنية خاصة على اراضي الدولة فقد قام المشرع الجزائري بسن قوانين ومراسيم للحد من هاته الظاهرة الجائرة على املاك الجماعة الوطنية بدءا من الاجراءات الادارية القبلية الى الاجراءات البعدية اخرها اصدار قانون 23-18 الذي يحمل في طياته عقوبات ردعية لكل من تسول له نفسه التعدي على اراضي الدولة فهو الاطار التشريعي الجديد الذي الذي جاء خصيصا لحماية اراضي الدولة والمحافظة عليها من كل اشكال التعدي على خلاف القانون رقم: 15-08 الذي كان يهدف الى : تسوية البنايات غير الشرعية فقانون 23-18 قانون ردع وحماية يضع اجراءات صارمة ضد اي اعتداء على الاملاك العمومية. وكذا اصدار قانون 23-21 المتعلق بالغابات والثروات الغابية واستحداث عدة عقوبات تقدر حسب الاضرار يصل الى حد السجن المؤبد واستحداث نصوص عقابية ضد كل استهتار من زائري الغابات وما قد تخلف تصرفاتهم من اخطار على الغابة وامتداد الحريق وذلك نظرا للحرائق التي اصابت الجزائري في السنوات الاخيرة وما خلفته من اضرار مادية وبشرية . .................................. Résumé Face aux empiétements généralisés sur le patrimoine national — et plus particulièrement sur les terres domaniales —, le législateur algérien a adopté des lois et des décrets visant à endiguer cette pratique qui porte atteinte à l'intérêt national collectif. Ces mesures s'échelonnent depuis des actions administratives préalables jusqu'à des dispositions coercitives ultérieures, pour aboutir à la promulgation de la loi n° 23-18. Ce nouveau cadre législatif est spécifiquement conçu pour protéger et préserver les terres de l'État contre toute forme d'empiétement illicite ; contrairement à la loi n° 15-08, qui visait à régulariser les constructions illégales, la loi n° 23-18 constitue un dispositif à la fois répressif et protecteur, instaurant des mesures rigoureuses à l'encontre de toute atteinte au domaine public. De même, la loi n° 23-21 relative aux forêts et aux ressources forestières a été promulguée, instaurant diverses sanctions — pouvant aller jusqu’à la réclusion à perpétuité — graduées en fonction de l’ampleur des dommages causés. Des dispositions ont également été prises pour sanctionner les comportements imprudents des visiteurs en forêt, afin de répondre aux risques que leurs agissements font peser sur le milieu forestier et aux risques de propagation d’incendies ; ces mesures ont été motivées par les feux ayant touché l’Algérie ces dernières années ainsi que par les pertes matérielles et humaines qui en ont résulté.
