Abstract

Abstract This study examines the grave Israeli violations committed following the events of 2023, as a contemporary case that raises significant legal issues within international humanitarian law and international human rights law, particularly regarding their legal characterization and the limits of international accountability. It focuses on the main forms of violations, including attacks against civilians, civilian infrastructure, medical facilities and personnel, as well as journalists and humanitarian workers, reflecting the breadth and severity of the conduct under examination and its impact on the protection afforded during armed conflicts. The study also addresses the issue of impunity by analyzing the effectiveness of international mechanisms in responding to such violations, in light of political and procedural constraints that affect their ability to ensure accountability and deterrence. The study concludes that the violations in question constitute serious breaches of international law, and that the persistence of impunity is more closely linked to the limited effectiveness of accountability mechanisms than to any deficiency in the legal framework itself. It therefore calls for strengthening international protection mechanisms and enhancing legal accountability tools in order to curb impunity and reinforce the principle of international responsibility. .............................. الملخص تتناول هذه الدراسة الانتهاكات الإسرائيلية الجسيمة المرتكبة بعد أحداث السابع من اكتوبر سنة 2023، باعتبارها نموذجًا معاصرًا يثير إشكالات قانونية جوهرية في إطار القانون الدولي الإنساني وقانون حقوق الإنسان، من حيث طبيعتها، وتكييفها القانوني، وحدود مساءلتها دوليًا. وقد ركزت الدراسة على أبرز صور هذه الانتهاكات التي مست المدنيين والبنية التحتية والمرافق الصحية والطواقم الطبية، إضافة إلى استهداف العاملين في المجال الإنساني والإعلامي، بما يعكس اتساع نطاق الأفعال محل البحث وخطورتها على الحماية الدولية المقررة أثناء النزاعات المسلحة. كما عالجت الدراسة إشكالية الإفلات من العقاب، من خلال إبراز حدود فعالية الآليات الدولية في التصدي لهذه الانتهاكات، في ظل ما يرافق عملها من قيود سياسية وإجرائية تؤثر على قدرتها في تحقيق الردع والمساءلة. وقد خلصت الدراسة إلى أن الانتهاكات محل البحث تمثل خرقًا جسيمًا لقواعد القانون الدولي، وأن استمرارها يرتبط بضعف فعالية منظومة المساءلة الدولية أكثر من ارتباطه بنقص في القواعد القانونية ذاتها، مما يستدعي تعزيز آليات الحماية الدولية وتفعيل أدوات المتابعة القانونية بما يضمن الحد من الإفلات من العقاب وترسيخ مبدأ المسؤولية الدولية. ............................... Résumé Cette étude examine les graves violations israéliennes commises à la suite des événements de 2023, en tant que cas contemporain soulevant d'importantes questions juridiques au regard du droit international humanitaire et du droit international des droits de l'homme, notamment en ce qui concerne leur qualification juridique et les limites de la responsabilité internationale. Elle se concentre sur les principales formes de violations, y compris les attaques contre les civils, les infrastructures civiles, les installations et le personnel médicaux, ainsi que les journalistes et les travailleurs humanitaires, reflétant ainsi l'ampleur et la gravité des actes examinés et leur impact sur la protection accordée pendant les conflits armés. L'étude aborde également la question de l'impunité en analysant l'efficacité des mécanismes internationaux face à ces violations, à la lumière des contraintes politiques et procédurales qui affectent leur capacité à garantir l'obligation de rendre des comptes et la dissuasion. L'étude conclut que les violations en question constituent des infractions graves au droit international, et que la persistance de l'impunité est davantage liée à l'efficacité limitée des mécanismes de responsabilisation qu'à une quelconque lacune du cadre juridique lui-même. Par conséquent, elle appelle à renforcer les mécanismes de protection internationale et à consolider les outils de responsabilité juridique afin de juguler l'impunité et de conforter le principe de la responsabilité internationale.
