Abstract

Summary : The Algerian legislator has worked to establish a set of environmental principles within its various legislations and laws, particularly through Law No. 03-10 relating to environmental protection within the framework of sustainable development, with the aim of creating a legal framework that ensures the protection of the environment against various forms of pollution and depletion. This was reflected through the adoption of a set of legal rules and mechanisms aimed at preventing environmental damage and reducing its effects, through preventive, repressive, and participatory principles, which have become the foundation of modern environmental policy in Algeria. However, the effective implementation of these principles still faces several difficulties, including the low level of environmental awareness and the lack of strict compliance with legal rules related to environmental protection, which affects the effectiveness of these principles in ach .................................... ملخص : سعى المشرع الجزائري إلى تكريس مجموعة من المبادئ البيئية ضمن مختلف تشريعاته و قوانينه ، خاصة من خلال القانون رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة، و ذلك بهدف وضع إطار قانوني يضمن حماية البيئة من مختلف أشكال التلوث و الاستنزاف. وقد تجلى ذلك من خلال إقرار مجموعة من القواعد والآليات القانونية التي تهدف إلى الوقاية من الأضرار البيئية والحد من آثارها، وذلك عبر مبادئ وقائية و ردعية و تشاركية ، والتي أصبحت تشكل أساس السياسة البيئية الحديثة في الجزائر. غير أن التطبيق الفعلي لهذه المبادئ لا يزال يواجه عدة صعوبات، من بينها قلة الوعي البيئي، وعدم الالتزام الصارم بالقواعد القانونية المتعلقة بحماية البيئة، الأمر الذي يؤثر على فعالية هذه المبادئ في تحقيق أهدافها وضمان حماية فعالة للبيئة . .................................... Résumé : Le législateur algérien a œuvré à consacrer un ensemble de principes environnementaux dans ses différentes législations et lois, notamment à travers la loi n° 03-10 relative à la protection de l’environnement dans le cadre du développement durable, et ce dans le but d’établir un cadre juridique garantissant la protection de l’environnement contre les différentes formes de pollution et d’épuisement. Cela s’est manifesté par l’adoption d’un ensemble de règles et de mécanismes juridiques visant à prévenir les dommages environnementaux et à limiter leurs effets, à travers des principes préventifs, répressifs et participatifs, qui constituent désormais le fondement de la politique environnementale moderne en Algérie. Cependant, l’application effective de ces principes continue de faire face à plusieurs difficultés, notamment le faible niveau de sensibilisation environnementale et le manque de respect strict des règles juridiques relatives à la protection de l’environnement, ce qui affecte l’efficacité de ces principes dans la réalisation de leurs objectifs et dans la garantie d’une protection efficace de l’environnement.
