دسترة حماية البيئة في الجزائر

Abstract

Summary: In recent decades, environmental protection has become one of the most important issues facing the world, especially with the emergence of new environmental challenges such as climate change, global warming, and increasing pressure on environmental resources, as well as other strange phenomena that are still under observation and study. This study aims to review the Algerian constitutional legislator's interest in environmental protection through an analysis of the Algerian constitutions and their amendments related to this subject, leading to a clear constitutional consecration of environmental protection, and the importance of this explicit consecration in enhancing environmental protection, and the associated precision and clarity of the legal rule and stability of legal texts, in harmony with the serious international interest in the future of the environment, and the adoption of many countries of legislation and policies to protect the environment and promote sustainability. Nevertheless, the environment as a value still faces many challenges, which require more efforts. The study also addressed the reasons that led to the constitutional consecration of environmental protection in Algeria, from international obligations, legislative development, environmental and social reality, and others, and the implications of this consecration on environmental legislation, by reviewing the recently issued laws and amendments affected by the explicit consecration of environmental protection, and the establishment of constitutional supervisory and advisory institutions related to environmental protection by virtue of the 2020 constitutional amendment, which would provide legal stability and further enhance environmental protection in Algeria. ........................................

الملخص: أصبحت حماية البيئة في العقود الأخيرة واحدة من أهم المسائل التي تواجه العالم، خاصة مع ظهور تحديات بيئية جديدة مثل التغير المناخي، الاحتباس الحراري، وزيادة الضغط على الموارد البيئية، وظواهر أخرى غريبة لازالت قيد الملاحظة والدراسة. تهدف هذه الدراسة إلى استعراض اهتمام المؤسس الدستوري الجزائري بحماية البيئة من خلال تحليل الدساتير الجزائرية وتعديلاتها المتعلقة بهذا الموضوع، وصولا إلى تكريس دستوري واضح لحماية البيئة، وما لهذه الدسترة الصريحة من أهمية في تعزيز حماية البيئة، وما يرتبط بها من دقة ووضوح للقاعدة القانونية واستقرار النصوص القانونية بما يحقق اليقين والأمن القانونيين، انسجاما مع الإهتمام الدولي الجاد بمستقبل البيئة، وقيام العديد من الدول بتبني تشريعات وسياسات لحماية البيئة وتعزيز الاستدامة، ومع ذلك، فإن البيئة كقيمة لا تزال تواجه العديد من الإشكالات، والتي تتطلب المزيد من الجهود. تناولت الدراسة أيضا، الأسباب التي أدت إلى تكريس حماية البيئة دستوريا في الجزائر، من إلتزامات دولية، تطور تشريعي، وواقع بيئي واجتماعي، وغيره ، وتداعيات هذه الدسترة على التشريعات البيئية، من خلال إستعراض القوانين والتعديلات الصادرة حديثا والمتأثرة بالدسترة الصريحة لحماية البيئة، وما أستحدث من مؤسسات دستورية رقابية واستشارية ذات الصلة بحماية البيئة بموجب التعديل الدستوري لسنة 2020، ما من شأنه توفير إستقرار قانوني، وتعزيز أكثر لحماية البيئة في الجزائر. ..................................... Résumé : Au cours des dernières décennies, la protection de l'environnement est devenue l'une des questions les plus importantes auxquelles le monde est confronté, en particulier avec l'émergence de nouveaux défis environnementaux tels que le changement climatique, le réchauffement climatique et la pression croissante sur les ressources environnementales, ainsi que d'autres phénomènes étranges qui sont encore sous observation et étude. Cette étude vise à examiner l'intérêt du législateur constitutionnel algérien pour la protection de l'environnement à travers une analyse des constitutions algériennes et de leurs amendements liés à ce sujet, aboutissant à une consécration constitutionnelle claire de la protection de l'environnement, et à l'importance de cette consécration explicite dans le renforcement de la protection de l'environnement, et à la précision et à la clarté associées de la règle de droit et à la stabilité des textes juridiques, en harmonie avec l'intérêt international sérieux pour l'avenir de l'environnement, et l'adoption par de nombreux pays de législations et de politiques visant à protéger l'environnement et à promouvoir la durabilité. Néanmoins, l'environnement en tant que valeur fait toujours face à de nombreux défis, qui nécessitent davantage d'efforts. L'étude a également abordé les raisons qui ont conduit à la consécration constitutionnelle de la protection de l'environnement en Algérie, des obligations internationales, du développement législatif, de la réalité environnementale et sociale, entre autres, et les implications de cette consécration sur la législation environnementale, en passant en revue les lois et amendements récemment promulgués et affectés par la consécration explicite de la protection de l'environnement, et la création d'institutions constitutionnelles de supervision et de conseil liées à la protection de l'environnement en vertu de l'amendement constitutionnel de 2020, ce qui permettrait d'assurer une stabilité juridique et de renforcer davantage la protection de l'environnement en Algérie.
