As for the trial, its is impossible to deny the role embodied by the judiciary through the existing sessions and the actul reaching of the person by trining trying to embody legal rules and making them not gust ink on paper, but a line that commands and forbids with one goal, whch is achieving international justice However the current reality show,to a large extent, variables in that, especially in the laws and decisions on which both the investigation and the trial must base themselves in order to eliminiate sirious international crimes. ................................... الملخص : إن رحلة التحقيق و المحاكمة لايمكن القول أنها رحلة صعبة لأنها دائما مايسعيان لتجسيد العدالة دون غيرها ، فبالنسبة للتحقيق فقد كان للمدعي العام دور بارزو مايبز ذلك هو تحريك الدعوى وجمع المعلومات والأدلة إلى غير ذلك، دون إنكار دور مجلس الأمن ،والتعاون الدولي المجسد بين المحكمة الجنائية الدولية والقضاء الوطني. أما بالنسبة للمحاكمة لايمكن إنكار الدور الذي يجسده القضاء من خلال الجلسات القائمة والتوصل الفعلى للشخص من خلال محاولة تجسيد القواعد القانونية وجعلها ليس فقط حبرا على ورق بل خطا يأمر وينهي بهدف واحد وهو تحقيق العدالة الدولية ،إلا أن الواقع الحالي يبين بنسبة كبيرة متغيرات في ذلك خاصة في القوانين والقرارات التي يجب أن يستند عليها كل من التحقيق والمحاكمة من أجل القضاء على الجرائم الدولية الخطيرة. ................................... Resume Le lien entre lenquete et le proces ne peut etre qualifie de simple ،car il sqgit dun lien organique visant a concerne lenquete le role du procureur general y est preponderant ce role consiste a engager laction publique a rassembler les informations et les preuves entre autres sans pour autant omettre le role du Conceil de securite et de la cooperation internationale incarnee par la Cour penale internationale et la justice nationale Quant au proces on ne peut nier le role determine par les juges a travers les audiences tenues afin de parvenir a la conda;ntion effective de la personne a travers lapplication des regles juridiques Cela implique non seulement de trancher mais egalement de veiller a que la justice international soit rendue Neanmoins la realite actuelle est marquee par de fortes divergences car il sagit dun domaine complexe notamment en ce qui concerne les lois et les decisions sur la base desquelles lenquete et proces doivent statuer afin de juger les crimes internationaux graves
