حقوق المرأة في قانون الأسرة الجزائري والاتفاقيات الدوليّة لحقوق الإنسان

The history of women is a blend of achievement and struggle, as most ancient societies viewed women with disdain, humiliation, and deprived them of the most basic rights. With the evolution of civilizations and the emergence of monotheistic religions, Islam appeared as a liberator for humanity as a whole, equating women with men in terms of fundamental human value and highlighting their importance in the family and society. Thus, Islamic law was the first to impose rights on women and protect them both in ancient and modern times. The latter saw the formation of the international community within the framework of what is known as international protection of human rights, where many general and specific international agreements emerged, guaranteeing women's rights and ensuring their protection through the protection mechanisms established by these agreements. Each contracting state is obligated, by virtue of its accession or approval of these agreements, to ensure compliance with them and to incorporate these rights into its domestic laws in line with these agreements. Algeria has, of course, ratified many agreements, leading it to amend its domestic laws to align with the content of the agreements, as evidenced by the Family Law under Order 05/02.
