Abstract

Abstract: The application of the principle of good faith in international commercial contracts is manifested through obliging the parties to comply with the requirements of fairness, integrity, transparency, and cooperation throughout the contractual relationship, as well as refraining from any conduct that may harm the other party or disturb the contractual equilibrium, it further entails an obligation to renegotiate the terms of the contract in the event of an exceptional and unforeseeable hardship, in order to preserve the stability and continuity of the contractual relationship. ................................ ملخص يظهر تطبيق مبدأ حسن النية في عقود التجارة الدولية عن طريق إلزام الأطراف باحترام مقتضيات النزاهة والأمانة والشفافية والتعاون المتبادل طوال فترة التعاقد، والامتناع عن كل ما من شأنه الأضرار بالطرف الآخر أو الاخلال بالتوازن العقدي، فضلا عن الالتزام بإعادة التفاوض في حال وقوع ظرف طارئ استثنائي غير متوقع، حفاظا على استقرار واستمرارية العلاقة التعاقدية. ............................... Résumé : L’application du principe de bonne foi dans les contrats du commerce international se manifeste par l’obligation faite aux parties de respecter les exigences de loyauté, d’honnêteté, de transparence et de coopération mutuelle tout au long de la relation contractuelle. Elle implique également l’abstention de tout comportement susceptible de nuire à l’autre partie ou de rompre l’équilibre contractuel, ainsi que l’obligation de renégocier le contrat en cas de survenance d’une circonstance exceptionnelle et imprévisible, afin de préserver la stabilité et la continuité de la relation contractuelle.
