Abstract Title: The Role of the International Court of Justice in addressing issues surrounding the Palestinian Question • Background: Over the last two decades, the Palestinian question has undergone a strategic shift in the international arena, moving from a negotiable political dispute to a strict international law issue. Confronted with political paralysis within the UN Security Council, Palestine and its allies have increasingly turned to the International Court of Justice (ICJ) as a forum for legal recourse. • Objectives: This study analyzes the cumulative and strategic impact of the ICJ's decisions between 2004 and 2024. It examines the Court’s role in defining the legal status of the occupied territories and establishing international responsibility for gross violations. • Key Findings: The study reviews four major judicial milestones: the 2004 Advisory Opinion on the Legal Consequences of the Construction of a Wall, the 2018 diplomatic litigation against the United States the 2024 Advisory Opinion declaring the occupation inherently unlawful, and South Africa’s 2023 genocide case agains t Israel. The findings indicate that the ICJ has successfully transitioned from merely "diagnosing" the situation to formally "prescribing" legal consequences, confirming that the occupation is illegal, annexation is null and void, and the systematic denial of self-determination must end immediately. • Conclusion: While the ICJ effectively strips the occupation of any legal legitimacy, the lack of coercive enforcement mechanisms poses a substantial barrier to translating these judicial triumphs into real-world political solutions. .................................. الملخص العنوان: دور محكمة العدل الدولية في معالجة القضايا المتعلقة بالقضية الفلسطينية الخلفية: شهدت القضية الفلسطينية خلال العقدين الماضيين تحولًا استراتيجيًا على الساحة الدولية، إذ انتقلت من كونها نزاعًا سياسيًا قابلًا للتفاوض إلى قضية قانونية تخضع لأحكام القانون الدولي. وفي ظل حالة الجمود السياسي التي أصابت مجلس الأمن التابع للأمم المتحدة، اتجهت فلسطين وحلفاؤها بصورة متزايدة إلى محكمة العدل الدولية باعتبارها إطارًا قانونيًا للجوء إلى العدالة الدولية. الأهداف: تهدف هذه الدراسة إلى تحليل الأثر التراكمي والاستراتيجي لقرارات محكمة العدل الدولية الصادرة خلال الفترة الممتدة بين عامي 2004 و2024، كما تبحث في دور المحكمة في تحديد الوضع القانوني للأراضي الفلسطينية المحتلة، وفي إرساء المسؤولية الدولية عن الانتهاكات الجسيمة للقانون الدولي. النتائج الرئيسة: تستعرض الدراسة أربع محطات قضائية بارزة، تتمثل في: الرأي الاستشاري الصادر سنة 2004 بشأن الآثار القانونية الناشئة عن تشييد الجدار في الأرض الفلسطينية المحتلة، والدعوى الدبلوماسية المرفوعة سنة 2018 ضد الولايات المتحدة الأمريكية، والرأي الاستشاري الصادر سنة 2024 الذي اعتبر الاحتلال غير مشروع في جوهره، إضافة إلى الدعوى التي رفعتها جمهورية جنوب أفريقيا سنة 2023 ضد إسرائيل بشأن انتهاك اتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها. وتبين النتائج أن محكمة العدل الدولية انتقلت من مجرد «تشخيص» الوضع القانوني إلى «تقرير الآثار القانونية والمسؤولية الدولية»، مؤكدة عدم مشروعية الاحتلال، وبطلان إجراءات الضم، وضرورة وضع حد للحرمان الممنهج للشعب الفلسطيني من حقه في تقرير المصير بشكل فوري ودون قيد أو شرط. الخاتمة: على الرغم من نجاح محكمة العدل الدولية في تجريد الاحتلال من أي شرعية قانونية، فإن غياب آليات التنفيذ الجبري لأحكامها وقراراتها لا يزال يشكل عائقًا رئيسًا أمام تحويل هذه المكاسب القانونية إلى حلول سياسية عملية على أرض الواق ......................................

Résumé Titre : Le rôle de la Cour internationale de Justice dans le traitement de la question palestinienne

• Contexte : Au cours des deux dernières décennies, la cause palestinienne a connu une transition stratégique sur la scène internationale, évoluant d'un différend politique négociable vers une question juridique inaliénable relevant du droit international. Face à la paralysie politique du Conseil de sécurité de l'ONU, la Palestine et ses alliés ont investi la Cour internationale de Justice (CIJ) comme ultime recours. • Objectifs : Cette étude vise à analyser l'impact cumulatif et stratégique des décisions de la CIJ entre 2004 et 2024. Elle examine le rôle de la Cour dans la définition du statut juridique des territoires palestiniens ainsi que dans la détermination de la responsabilité internationale pour violations graves. • Principaux résultats : L'analyse examine quatre jalons juridiques majeurs : l'avis consultatif de 2004 sur le Mur de séparation, le recours de 2018 contre les États-Unis, l'avis de 2024 déclarant l'occupation illégale dans son essence même, et l'action intentée par l'Afrique du Sud en 2023 pour violation de la Convention sur le génocide. Les résultats démontrent que la CIJ est passée du simple « diagnostic » à la « prescription de la responsabilité », établissant le caractère illicite de l'occupation, la nullité des annexions et l'obligation d'y mettre fin sans condition. • Conclusion : Si la CIJ réussit à priver l'occupation de toute légitimité juridique, l'absence de mécanismes d'exécution forcée demeure le principal obstacle pour transformer ces acquis juridiques en réalité politique concrète.
