دور اتفاقيات حقوق الإنسان في حماية حقوق المتهم أمام أجهزة القضاء الدولي

Abstract

Abstract Human rights conventions constitute a fundamental international legal framework aimed at promoting and protecting the rights of individuals, particularly defendants before international judicial bodies. These conventions have contributed to establishing a set of essential principles, such as the presumption of innocence, the right to defense, the right to a fair trial, and the prohibition of torture and inhuman or degrading treatment. These rights represent fundamental guarantees for every defendant before international justice. This role has been reflected through various international legal instruments, notably the International Covenant on Civil and Political Rights (ICCPR), which explicitly provides for fair trial guarantees, as well as through the work of international judicial institutions such as the International Criminal Court (ICC), whose procedures are based on these principles to ensure the protection of defendants' rights. Through the present study, we have reached the following conclusions: Answer to the Research Problem Despite the significant role of human rights conventions in protecting the rights of defendants before international judicial bodies, their effectiveness remains relative rather than absolute. These conventions provide substantial protection by establishing binding legal standards and requiring states to respect them. However, their effectiveness is influenced by several factors, including: • The varying levels of states' compliance with the implementation of these conventions; • The weakness of international monitoring and enforcement mechanisms; • The political nature of certain international cases; • The limited jurisdiction of some international judicial bodies. Recommendations and Suggestions To enhance the effectiveness of these conventions, the following measures are recommended: 1. Strengthening international monitoring mechanisms to ensure respect for defendants' rights; 2. Expanding the jurisdiction of international judicial bodies and providing them with more effective enforcement tools; 3. Requiring states to harmonize their domestic legislation with international standards; 4. Reinforcing the independence of international justice from political influence; 5. Promoting legal awareness of defendants' rights at the international level. ............................... الملخص تُعدّ اتفاقيات حقوق الإنسان إطارًا قانونيًا دوليًا أساسيًا يهدف إلى تكريس وحماية حقوق الأفراد، وعلى رأسهم المتهمون أمام أجهزة القضاء الدولي. فقد ساهمت هذه الاتفاقيات في إرساء مجموعة من المبادئ الجوهرية، مثل قرينة البراءة، وحق الدفاع، والمحاكمة العادلة، ومنع التعذيب والمعاملة اللاإنسانية، وهي حقوق تشكل ضمانات أساسية لكل متهم أمام العدالة الدولية. وقد تجسد هذا الدور من خلال العديد من الصكوك الدولية، على غرار العهد الدولي الخاص بالحقوق المدنية والسياسية، الذي نص صراحة على ضمانات المحاكمة العادلة، وكذلك من خلال عمل هيئات قضائية دولية مثل المحكمة الجنائية الدولية، التي تعتمد في إجراءاتها على هذه المبادئ لضمان حماية حقوق المتهمين. ومن خلال ما قدمناه خلال دراستنا وصلنا في النهاية إلى: الإجابة على الإشكالية: رغم الأهمية الكبيرة لاتفاقيات حقوق الإنسان في حماية حقوق المتهم أمام القضاء الدولي، إلا أن فعاليتها تبقى نسبية وليست مطلقة. فهي تحقق حماية معتبرة من خلال وضع معايير قانونية ملزمة وإلزام الدول باحترامها، غير أن هذه الفعالية تتأثر بعدة عوامل، من بينها: • تفاوت التزام الدول بتنفيذ هذه الاتفاقيات؛ • ضعف آليات الرقابة والتنفيذ الدولي؛ • الطابع السياسي لبعض القضايا الدولية؛ • محدودية اختصاص بعض أجهزة القضاء الدولي. التوصيات والاقتراحات: لتعزيز فعالية هذه الاتفاقيات، يمكن اقتراح ما يلي: 1. تعزيز آليات الرقابة الدولية لضمان احترام حقوق المتهم؛ 2. توسيع اختصاص أجهزة القضاء الدولي وتمكينها من وسائل تنفيذ أكثر فعالية؛ 3. إلزام الدول بتكييف تشريعاتها الوطنية مع المعايير الدولية؛ 4. تعزيز استقلالية القضاء الدولي بعيدًا عن التأثيرات السياسية؛ 5. نشر الوعي القانوني بحقوق المتهم على المستوى الدولي ........................................ Résumé Les conventions relatives aux droits de l’homme constituent un cadre juridique international fondamental visant à consacrer et à protéger les droits des individus, notamment ceux des accusés devant les juridictions internationales. Ces conventions ont contribué à l’instauration de plusieurs principes essentiels, tels que la présomption d’innocence, le droit à la défense, le droit à un procès équitable, ainsi que l’interdiction de la torture et des traitements inhumains ou dégradants. Ces droits représentent des garanties fondamentales pour toute personne poursuivie devant la justice internationale. Ce rôle s’est concrétisé à travers plusieurs instruments internationaux, notamment le Pacte international relatif aux droits civils et politiques, qui prévoit expressément les garanties du procès équitable, ainsi qu’à travers l’action des juridictions internationales telles que la Cour pénale internationale, laquelle fonde ses procédures sur ces principes afin d’assurer la protection des droits des accusés. À travers notre étude, nous sommes finalement parvenus à : Réponse à la problématique : Malgré l’importance majeure des conventions relatives aux droits de l’homme dans la protection des droits de l’accusé devant la justice internationale, leur efficacité demeure relative et non absolue. Elles assurent une protection considérable grâce à l’établissement de normes juridiques contraignantes et à l’obligation imposée aux États de les respecter. Toutefois, cette efficacité reste influencée par plusieurs facteurs, parmi lesquels : • La différence du degré d’engagement des États dans l’application de ces conventions ; • La faiblesse des mécanismes internationaux de contrôle et d’exécution ; • Le caractère politique de certaines affaires internationales ; • La limitation de la compétence de certaines juridictions internationales. Recommandations et propositions : Afin de renforcer l’efficacité de ces conventions, il est possible de proposer ce qui suit : 1. Renforcer les mécanismes internationaux de contrôle afin de garantir le respect des droits de l’accusé ; 2. Élargir les compétences des juridictions internationales et leur fournir des moyens d’exécution plus efficaces ; 3. Obliger les États à adapter leurs législations nationales aux normes internationales ; 4. Renforcer l’indépendance de la justice internationale loin des influences politiques ; 5. Diffuser la culture juridique relative aux droits de l’accusé au niveau international.
