Abstract

ABSTRACT This study examines the legal and institutional framework of the African Court on Human and Peoples' Rights (AfCHPR), as the continental judicial arm dedicated to the protection of human rights in Africa. The research aims to highlight the historical trajectory of the Court’s establishment, beginning with the OAU Charter and leading to the 1998 Ouagadougou Protocol, while analyzing its organizational structure and the guarantees of independence for its 11 judges. The study provides a detailed analysis of the Court’s contentious and advisory jurisdictions, highlighting the types of cases it adjudicates and the mechanisms for access by individuals and non-governmental organizations (NGOs). Furthermore, it conducts a comparative analysis with other regional systems—such as the European and Inter-American Courts—to illustrate mutual influences and shared legal standards. The second part of the study focuses on evaluating the Court's effectiveness in protecting vulnerable groups, as well as the complementary relationship between the AfCHPR, the International Criminal Court (ICC), and the African Court of Justice. In conclusion, the study finds that while the Court has achieved tangible judicial milestones, it continues to face legal and political challenges that hinder its performance. This necessitates the activation of remedial measures to enhance the overall African justice system. ................................ مــــلــــخـــــص ​ تناول هذه الدراسة النظام القانوني والمؤسساتي للمحكمة الأفريقية لحقوق الإنسان والشعوب، باعتبارها الذراع القضائي القاري المعني بحماية حقوق الإنسان في أفريقيا. تهدف الدراسة إلى تسليط الضوء على المسار التاريخي لنشأة المحكمة، بدءاً من ميثاق منظمة الوحدة الأفريقية وصولاً إلى "بروتوكول "واغادوغو" لعام 1998، مع تحليل هيكلها التنظيمي وضمانات استقلالية قضاتها الحادي عشر. ​ تطرقت المذكرة بشكل مفصل إلى الاختصاصات القضائية والاستشارية للمحكمة، مبرزةً طبيعة القضايا التي تنظر فيها وآليات نفاذ الأفراد والمنظمات غير الحكومية إليها، مع إجراء مقارنة تحليلية مع الأنظمة الإقليمية الأخرى (كالمحكمة الأوروبية والأمريكية) لبيان أوجه التأثر والتأثير. ​ كما ركزت الدراسة في شقها الثاني على تقييم فعالية المحكمة في حماية حقوق الفئات الهشة والعلاقة التكاملية بينها وبين المحكمة الجنائية الدولية والمحكمة الأفريقية للعدل. وفي الختام، خلصت الدراسة إلى أن المحكمة، رغم ما حققته من مكتسبات قضائية ملموسة، لا تزال تواجه تحديات قانونية وسياسية تعيق أداءها، مما يستوجب تفعيل سبل معالجة القصور للارتقاء بمنظومة العدالة الأفريقية. ............................... Résumé Cette étude examine le régime juridique et institutionnel de la Cour africaine des droits de l'homme et des peuples, en tant que bras judiciaire continental chargé de la protection des droits de l'homme en Afrique. L'étude vise à mettre en lumière le parcours historique de la création de la Cour, depuis la Charte de l'Organisation de l'unité africaine jusqu'au « Protocole de Ouagadougou » de 1998, tout en analysant sa structure organisationnelle et les garanties d'indépendance de ses 11 juges. ​ Le mémoire aborde en détail les compétences judiciaires et consultatives de la Cour, mettant en évidence la nature des affaires qu'elle examine ainsi que les mécanismes d'accès des individus et des organisations non gouvernementales à celle-ci, tout en effectuant une comparaison analytique avec d'autres systèmes régionaux (tels que la Cour européenne et interaméricaine) afin de dégager les aspects d'influence mutuelle. ​ Dans sa seconde partie, l'étude se concentre également sur l'évaluation de l'efficacité de la Cour dans la protection des droits des catégories vulnérables, ainsi que sur la relation complémentaire entre celle-ci, la Cour pénale internationale et la Cour africaine de justice. En conclusion, l'étude révèle que la Cour, malgré les acquis judiciaires concrets qu'elle a réalisés, reste confrontée à des défis juridiques et politiques qui entravent sa performance, ce qui nécessite l'activation de solutions pour pallier ces lacunes afin de promouvoir le système de justice africain.
