دور الاتحاد الأوروبي في حمايــــة حقوق الإنســان

Abstract

Summary: The protection of human rights is one of the fundamental principles on which the European Union is founded; it has worked to develop a legal and institutional framework designed to ensure respect for fundamental rights and freedoms. The Treaties of Maastricht, Amsterdam and Lisbon, alongside the Charter of Fundamental Rights, have contributed to strengthening the human rights dimension within the Union and consolidating the values of democracy and the rule of law. The Union’s commitment to the European human rights protection system is further reinforced by its alignment with the provisions of the European Convention on Human Rights and its pursuit of accession to it, despite the legal challenges involved. The protection of human rights within the Union relies on various judicial and political mechanisms, most notably the role played by the Court of Justice of the European Union in safeguarding fundamental rights, as well as the contribution of the Union’s political institutions in promoting respect for human rights within Member States. This role extends to the external sphere by linking cooperation agreements to respect for human rights and by adopting pressure mechanisms and sanctions against states where there are serious violations of these rights. ........................ تُعد حماية حقوق الإنسان من المبادئ الأساسية التي يقوم عليها الاتحاد الأوروبي، حيث عمل على تطوير منظومة قانونية ومؤسساتية تهدف إلى ضمان احترام الحقوق والحريات الأساسية. وقد ساهمت معاهدات ماستريخت وأمستردام ولشبونة، إلى جانب ميثاق الحقوق الأساسية، في تعزيز البعد الحقوقي داخل الاتحاد وترسيخ قيم الديمقراطية وسيادة القانون. كما تعزز ارتباط الاتحاد بالنظام الأوروبي لحماية حقوق الإنسان من خلال التقارب مع أحكام الاتفاقية الأوروبية لحقوق الإنسان والسعي إلى الانضمام إليها رغم ما يرافق ذلك من تحديات قانونية. وتعتمد حماية حقوق الإنسان داخل الاتحاد الأوروبي على آليات قضائية وسياسية متعددة، أبرزها الدور الذي تؤديه محكمة العدل للاتحاد الأوروبي في حماية الحقوق الأساسية، إضافة إلى مساهمة المؤسسات السياسية للاتحاد في دعم احترام حقوق الإنسان داخل الدول الأعضاء. ويمتد هذا الدور إلى المجال الخارجي عبر ربط اتفاقيات التعاون باحترام حقوق الإنسان واعتماد وسائل الضغط والعقوبات اتجاه الدول التي تشهد انتهاكات جسيمة لهذه الحقوق. .............................. Résumée La protection des droits de l’homme constitue l’un des principes fondamentaux sur lesquels repose l’Union européenne. Celle-ci a œuvré à l’élaboration d’un cadre juridique et institutionnel visant à garantir le respect des droits et des libertés fondamentales. Les traités de Maastricht, d’Amsterdam et de Lisbonne, ainsi que la Charte des droits fondamentaux de l’Union européenne, ont largement contribué à renforcer la dimension des droits fondamentaux au sein de l’Union, en consacrant les valeurs de démocratie, d’État de droit et de respect des droits de l’homme. Le système européen de protection des droits de l’homme s’est également rapproché des dispositions de la Convention européenne des droits de l’homme, l’Union européenne ayant entrepris des démarches en vue de son adhésion à cette Convention, malgré les difficultés juridiques rencontrées. La protection des droits de l’homme au sein de l’Union repose sur plusieurs mécanismes judiciaires et politiques, au premier rang desquels figure le rôle de la Cour de justice de l’Union européenne dans la garantie des droits fondamentaux, ainsi que l’action des institutions politiques de l’Union pour promouvoir le respect des droits de l’homme dans les États membres. Ce rôle s’étend également à l’action extérieure de l’Union, notamment par l’intégration du respect des droits de l’homme dans les accords de coopération, ainsi que par le recours à des moyens de pression et à des sanctions à l’encontre des États responsables de violations graves de ces droits.
