دسترة مكافحة الفساد على ضوء التعديل الدستوري الجزائري

Abstract

Abstract: As part of our study of the subject matter of our memorandum, we have tried to answer the problem posed by the Constitution against Corruption under the 2020 Amendment. In our endeavour to answer this problem, we have dealt with the concept of corruption as well as its types of motives and the reasons for its spread. Law No. 06/01 on the Prevention and Control of Corruption was adopted by Algerian legislation. The Algerian legislature has also created a number of mechanisms, including the National Anti-Corruption Commission, the National Office for the Suppression of Corruption and the Accounting Council. In 2020, the Algerian legislature established the Supreme Transparency Authority. It also focused on civil society's significant role in combating and preventing corruption. Finally, we can say that Algerian legislation is a kind of mechanism for combating and preventing corruption and that it is taking the right approach to getting rid of its thousands and its negative and serious repercussions on society. ......................... ملخص في إطار دراستنا لموضوع مذكرتنا حاولنا الإجابة عن الإشكالية المطروحة حول دسترة مكافحه الفساد في ظل التعديل 2020 وفي إطار سعينا للإجابة عن هذه الإشكالية تناولنا مفهوم الفساد وكذا أنواعه دوافعه وأسباب انتشاره كما تطرقنا في بحثنا هذا إلى سبل التي سلكها المشرع الجزائري لمكافحه الفساد، حيث جاء المشرع الجزائري بالقانون 01/06 المتعلق بالوقاية من الفساد ومكافحته وأبرز ما اتبعه المشرع الجزائري هو الاتفاقيات الدولية وتجارب الدولية السابقة في هذا الإطار. كما خلق المشرع الجزائري العديد من الآليات منها الهيئة الوطنية لمكافحة الفساد كذلك ديوان الوطني لقمع الفساد، ومجلس المحاسبة وفي سنه 2020 قام المشرع الجزائري في التعديل الأخير بإنشاء السلطة العليا للشفافية كما ركز على دور المجتمع المدني الكبير في مكافحه الفساد والوقاية منه. وفي الأخير يمكن أن نقول بان المشرع الجزائري نوع من آليات مكافحه الفساد والوقاية منه وانه يسير في النهج الصحيح للتخلص من هذه آلافه وانعكاساتها السلبية والخطيرة على المجتمع.

Résumé : Dans le cadre de notre étude de l’objet de notre mémorandum, nous avons tenté de répondre au problème posé par la Constitution contre la corruption en vertu de l’Amendement 2020. Dans nos efforts pour résoudre ce problème, nous nous sommes penchés sur le concept de la corruption ainsi que sur ses motifs et les raisons de sa propagation. La loi n° 06/01 sur la prévention et le contrôle de la corruption a été adoptée par la législation algérienne. La législature algérienne a également créé un certain nombre de mécanismes, dont la ommission nationale anti-corruption, le Bureau national pour la répression de la corruption et le Conseil comptable. En 2020, le législateur algérien a créé l’Autorité suprême de transparence. Il a également mis l’accent sur le rôle important de la société civile dans la lutte et la prévention de la corruption. Enfin, nous pouvons dire que la législation algérienne est une sorte de mécanisme de lutte et de prévention de la corruption et qu’elle adopte la bonne approche pour se débarrasser de ses milliers et de ses répercussions négatives et graves sur la société.
