Abstract

Summary Based on the need for the criminal field to benefit from the data of scientific development, modern criminal policy has aspired to innovate measures and alternatives to the deprivation of liberty punishment that are more effective, such as the electronic monitoring system, as placing under electronic surveillance is considered one of the new alternatives to implementing the deprivation of liberty punishment outside the prison walls, which the legislator has adopted. Like the comparative legislation in Law No. 18/01, supplemented and amended by Law No. 05/04, which includes the organization of prisons and the social reintegration of detainees, This method includes an electronic remote monitoring system through which the presence or absence of a person from the place designated for his residence can be confirmed pursuant to a judicial ruling. The convict is allowed to remain in his home, but his movements are limited and monitored by a device installed on his wrist or on the bottom of his foot known as an electronic bracelet. ملخص المذكرة: انطلاقا من ضرورة استفادة المجال الجنائي من معطيات التطور العلمي ، تطلعت السياسة الجنائية الحديثة، الى ابتكار تدابير و بدائل للعقوبة السالبة للحرية تكون اكثر فعالية كنظام المراقبة الالكترونية ، حيث يعتبر الوضع تحت المراقبة الالكترونية من البدائل المستحدثة لتنفيذ العقوبة السالبة للحرية خارج اسوار السجن والذي تبناه المشرع الجزائري شأنه شأن التشريعات المقارنة في القانون 18/01 المتمم و المعدل بالقانون رقم 05/04 المتضمن تنظيم السجون و إعادة الإدماج الاجتماعي للمحبوسين ، و يتضمن هذا الأسلوب نظام إلكتروني للمراقبة عن بعد بموجبه يمكن التأكد من وجود أو غياب الشخص عن المكان المخصص لإقامته بموجب حكم قضائي ، حيث يسمح للمحكوم عليه بالبقاء في منزله لكن تحركاته محدودة و مراقبة بواسطة جهاز مثبت في معصمه أو في أسفل قدمه يعرف بالسوار الإلكتروني ، فتحل هنا محل الحارس. ........................ Résumé Suite à l’importance de bénéfice le domaine pénal de bénéficier des données du développement scientifique , la politique pénale moderne a visé à innover des mesures et des substituts aux peines privatives de liberté plus efficaces , comme le système de surveillance électronique . La situation sous surveillance électronique étant considérée comme l’une des nouvelles substitués à la mise en œuvre de la sanction privant de liberté hors des murs de la prison, qui a été adoptée par le législateur algérien , de même que la législation comparative de la loi 01 /18 complétée et modifié par la loi n° 04/05 sur l’organisation des prisons et la réinsertion sociale des détenus , et cette méthode comprend un système électronique de surveillance à distance , selon laquelle il est possible de constater la présence ou l’absence d’une personne du lieu désigné pour sa résidence selon un jugement , car le condamné est à autorisé à rester chez lui , mais ses mouvement sont limités et surveillés par un dispositif installé dans son poignet ou au bas de son pied appelé bracelet électronique , danc la technologie remplace ici le garde.
