الفساد الإداري في مجال الإدارة البلدية في الجزائر

Abstract

Summary: Administrative corruption undermines the credibility of the State and the administrative apparatus. Because the diagnosis of the problem is the first stage of the fight, we analyzed the phenomenon of corruption by identifying what it is and the various historical developments it has undergone, its types, its manifestations and even the reasons for its occurrence. Since the Department's driving hand is the public servant, we wanted to identify his position in the crimes of administrative corruption and the nature of his relationship with them. We also highlighted the municipal administration in particular for its close association with individuals due to the nature of the services it provides. Our study presents the various constituent structures of the municipal administration, starting with the Municipal People's Assembly, which has been subjected to the functioning and powers of the Council, as well as the Chairperson of the Municipal People's Council, as well as the composition and powers of the Council, to the manifestations of administrative corruption that appear in such bodies, affecting all levels of the labour hierarchy of the latter. And in order to reduce this phenomenon, we have addressed mechanisms to combat this type of corruption that have varied from administrative control mechanisms to other A sanction that seeks to minimize its risks. ....................... ملخص : إن الفساد الإداري یضرب بمصداقیة الدولة والجهاز الإداري ،ولأن تشخیص المشكلة هو أول مراحل المكافحة فقد قمنا بتحلیل ظاهرة الفساد وذلك بالتعرف على ماهیته ومختلف التطورات التاریخیة التي مر بها وأنواعه ومضاهره وحتى الأسباب التي تدفع لحدوثه ،وبما أن الید المحركة للإدارة هي الموظف العام فقد أردنا أن نتبین موقعه في جرائم الفساد الإداري وطبیعة علاقته بها ،كما سلطنا الضوء على الإدارة البلدیة خاصة وذلك لإرتباطها الوثیق بالأفراد نظرا لطبیعة الخدمات التي تقدمها. فتعرضنا في دراستنا لمختلف الهیئات المكونة للإدارة البلدیة بدءا بالمجلس الشعبي البلدي الذي تعرضنا إلى كیفیة تسییره وصلاحیاته وكذا رئیس المجلس الشعبي البلدي وكیفیة تنصیبه وصلاحیاته وصولا إلى مظاهر الفساد الإداري التي تظهر في مثل هذه الهیئات والتي تمس جمیع مستویات الهرم الوظیفي لهذه الأخیرة ،وسعیا للحد من هده الظاهرة فقد تناولنا آلیات مكافحة هذا النوع من الفساد والتي تنوعت من آلیات رقابیة إداریة إلى آخرى جزائیة التي تسعى للتقلیل من مخاطره. ....................... Résumé : La corruption administrative touche directement la crédibilité de l’état et su système administratif. En considérant l’identification du problème et le premier pas dans la lutte, nous avons analysé ce phénomène, son concept, son évolution historique, ses différents types, les formes qu’il prend et ses différentes causes. En tant que l’employer est l’acteur principale dans l’administration nous avons essayé d’identifier son rôle dans les crimes de la corruption administrative et la nature de sa relation avec celle-ci. Et nous avons mis en évidence précisément l’administration communale publique étant donné ; son domaine d’interaction vaste avec les individus et la nature des services qu’elle subvient ; par l’étude de ses différents composants dans l’échelle organisationnelle et les différentes formes de corruptions qui peuvent se manifester dans ces derniers. Et dans le but de sensibilisation et de lutte contre ce phénomène nous avons abordé les mécanismes de contrôle de ce type de corruption qui se varient des mécanismes réglementaires administratifs aux mécanismes punitifs.
