For the first time, the legislature adopted the Independent Electoral Administration from the executive branch, which not only granted the independent authority supervisory powers but went beyond this to include the administration, organization and supervision of the elections from the beginning until the preliminary results were announced to highlight its effective and vital role at all stages of the electoral process, as well as a range of deterrent mechanisms that help it to extend its control and implement its decisions, ensuring the independence of the electoral process and protecting voters' right to express their will freely. ............................... ملخص المذكرة: نتيجة للحراك الشعبي الذي عرفته الجزائر سنة 2019 و الذي كان من أحد أبرز ما جاء به إصلاح النظام الانتخابي من أجل ضمان شرعية النظام السياسي في البلاد الذي من شأنه أن يعكس إرادة الشعب في إختيار من ينوبه في وضع قراراته و تسيير شؤونهم، سارع المشرع الجزائري إلى إستحداث هيئة مستقلة و المتمثلة في "السلطة الوطنية المستقلة للانتخابات" كآلية رقابية تعهد لها مهمة السهر على شفافية و نزاهة العملية الانتخابية، و حماية نتائجها من أي تلاعب أو تجاوز يؤثر عليها و ذلك من خلال القانون العضوي 19/07 المتعلق بالسلطة الوطنية المستقلة للانتخابات ليتم بعد ذلك دسترتها في التعديل الدستوري لسنة 2020 و إدراجها ضمن مؤسسات الرقابة في الباب الرابع منه ليعزز بذلك المكانة الدستورية المهمة للسلطة المستقلة، ثم إدراجها بعد ذلك في الأمر 21/01 المتعلق بنظام الانتخابات الذي نظم الهيئة و بين الأجهزة المكونة لها و المتمثلة في جهاز تداولي و هو مجلس السلطة و جهاز تنفيذي و هو رئيس السلطة المستقلة و كذلك لها إمتدادات على المستوى المحلي و الخارجي، بالإضافة إلى أنه أحاطها بعدة ضمانات من شأنها أن تكفل إستقلاليتها و سيادتها على عكس الهيئات السابقة. فلأول مرة يتبنى المشرع الإدارة الانتخابية المستقلة عن السلطة التنفيذية حيث لم يكتفي بمنح السلطة المستقلة صلاحيات رقابية فقط بل تجاوزت ذلك لتشمل الإدارة والتنظيم و الإشراف على الانتخابات منذ بدايتها إلى غاية إعلان النتائج الأولية، لإبراز دورها الفعال و الحيوي في جميع المراحل التي تمر بها العملية الانتخابية كما مُنح لها أيضا مجموعة من الآليات الردعية التي تساعدها على بسط رقابتها و تنفيذ قراراتها مما يضمن إستقلالية العملية الانتخابية و حماية حق الناخبين في التعبير إرادتهم بحرية. .......................... Résumé : A la suite du mouvement populaire algérien de 2019, qui a été l’un des traits les plus marquants de la réforme du système électoral afin d’assurer la légitimité du système politique dans le pays, qui refléterait la volonté du peuple de choisir ses représentants dans la formulation de ses décisions et la conduite de ses affaires, le législateur algérien s’est empressé de créer un organe indépendant. "Autorité électorale nationale indépendante" en tant que mécanisme de suivi chargé d’assurer la transparence et l’intégrité du processus électoral et de protéger ses résultats de toute manipulation ou abus les affectant par le biais de la loi organique du 19/07 sur l’autorité électorale nationale indépendante, qui sera ensuite incorporée dans l’amendement constitutionnel de 2020 et incorporée dans les institutions de surveillance du titre IV, renforçant ainsi la position constitutionnelle importante de l’autorité indépendante; Par la suite, il a été inclus dans l’ordonnance 21/01 sur le système électoral, qui réglementait la Commission et ses organes constitutifs, à savoir, un organe délibératif, le Conseil d’autorité, un organe exécutif, le chef de l’autorité indépendante, ainsi que des extensions locales et externes. Pour la première fois, la législature a adopté l’administration électorale indépendante du pouvoir exécutif, qui non seulement a accordé les pouvoirs de contrôle de l’autorité indépendante, mais est allé au-delà pour inclure l’administration, l’organisation et le contrôle des élections depuis le début jusqu’à l’annonce des résultats préliminaires pour mettre en évidence son rôle efficace et vital à toutes les étapes du processus électoral, ainsi qu’un éventail de mécanismes de dissuasion qui l’aident à étendre son contrôle et à mettre en œuvre ses décisions, à assurer l’indépendance du processus électoral et à protéger le droit des électeurs d’exprimer librement leur volonté.
