Abstract

Summary: Constitutional control of laws is the fundamental rule in the State for the protection of rights and freedoms. This control is based on a number of principles. The most important of these is the principle of the supremacy of the Constitution and the principle of separation of powers. The Constitutional Council protects legitimacy and monitors elections. And his constitutional control of the two laws is purely political, but despite the utmost importance of such oversight and the importance of the council exercising such oversight, there are still some limitations that prevent his uncle more effectively, such as the above-mentioned limitations on notification and otherwise that may affect the protection of rights and freedoms. ...................... ﻣﻠﺧص: ﺗﻌﺗﺑر اﻟرﻗﺎﺑﺔ اﻟدﺳﺗورﯾﺔ ﻋﻠﻰ اﻟﻘواﻧﯾن اﻟﻘﺎﻋدة اﻷﺳﺎﺳﯾﺔ ﻓﻲ اﻟدوﻟﺔ ﻟﺣﻣﺎﯾﺔ اﻟﺣﻘوق واﻟﺣرﯾﺎت، وﺗﻌﺗﻣد ﻫذﻩ اﻟرﻗﺎﺑﺔ ﻋﻠﻰ اﻟﻌدﯾد ﻣن اﻟﻣﺑﺎدئ وﻟﻌل أﺑرزﻫﺎ ﻫو ﻣﺑدأ ﺳﻣو اﻟدﺳﺗور وﻣﺑدأ اﻟﻔﺻل ﺑﯾن اﻟﺳﻠطﺎت. أﻣﺎ ﻓﻲ ﻣﺎ ﯾﺧص اﻟﻬﯾﺋﺔ اﻟﻣﻣﺎرﺳﺔ ﻟﻬﺎﺗﻪ اﻟرﻗﺎﺑﺔ ﻓﺗﺗﻣﺛل ﻓﻲ اﻟﻣﺟﻠس اﻟدﺳﺗوري اﻟذي ﯾﻘوم ﺑﺣﻣﺎﯾﺔ اﻟﻣﺷروﻋﯾﺔ وﻣراﻗﺑﺔ اﻻﻧﺗﺧﺎﺑﺎت، و رﻗﺎﺑﺗﻪ اﻟدﺳﺗورﯾﺔ ﻋﻠﻰ اﻟﻘواﻧﯾن ﻫﻲ رﻗﺎﺑﺔ ﺳﯾﺎﺳﯾﺔ ﺑﺣﺗﺔ، وﻟﻛن رﻏم اﻷﻫﻣﯾﺔ اﻟﺑﺎﻟﻐﺔ ﻟﻬﺎﺗﻪ اﻟرﻗﺎﺑﺔ وأﻫﻣﯾﺔ اﻟﻣﺟﻠس اﻟذي ﯾﻣﺎرس ﻫذﻩ اﻟرﻗﺎﺑﺔ ﻓﺎﻧﻪ ﻣﺎزاﻟت ﺑﻌض اﻟﻘﯾود اﻟﺗﻲ ﺗﺣول دون ﻋﻣﺎﻩ ﺑﺷﻛل ﻓﻌﺎل أﻛﺛر ﻛﺎﻟﻘﯾود اﻟﺳﺎﺑق ذﻛرﻫﺎ ﻋﻠﻰ اﻹﺧطﺎر وﻏﯾرﻫﺎ اﻟﺗﻲ ﻗد ﺗؤﺛر ﻋﻠﻰ ﺣﻣﺎﯾﺔ ﻟﻠﺣﻘوق واﻟﺣرﯾﺎت . .......................

Résumé : Le contrôle constitutionnel des lois est la règle fondamentale de l’État pour la protection des droits et libertés. Ce contrôle repose sur un certain nombre de principes. Le plus important est le principe de la suprématie de la Constitution et le principe de la séparation des pouvoirs. Le Conseil constitutionnel protège la légitimité et surveille les élections. Et son contrôle constitutionnel des deux lois est purement politique, mais malgré la plus grande importance d’un tel contrôle et l’importance du conseil d’exercer un tel contrôle, il y a encore quelques limites qui empêchent son oncle plus efficacement, tels que les limitations susmentionnées en matière de notification et autrement susceptibles d’affecter la protection des droits et libertés.
