Abstract

Abstract The protection of victims in both international and national criminal law is a subject of significant importance, especially in light of the increasing grave violations of human rights and armed conflicts, as well as the growing number of victims in need of legal protection and effective justice at the international and national levels. These systems aim to achieve justice and fairness by enabling victims to participate in judicial proceedings, obtain compensation, and receive protection during trials—whether in the context of international crimes, national crimes, or human rights violations. However, a gap still exists between legal provisions and their practical implementation, particularly as victims often suffer from exclusion and neglect in criminal procedures at both the international and national levels. Therefore, it is essential to adopt a comprehensive approach that integrates legal protection with psychological and social support, involves victims in justice processes, and strengthens victim protection mechanisms. This includes updating national legislation, activating redress and compensation mechanisms, reinforcing the role of international and national organizations, and promoting a culture of respect for victims' rights as a fundamental component of building justice and the rule of law. ....................... الملخص حماية الضحايا في التشريع الجنائي الدولي والوطني، هو من المواضيع ذات الأهمية البالغة في ظل تنامي الانتهاكات الجسيمة لحقوق الإنسان والنزاعات المسلحة، وازدياد عدد الضحايا الذين يحتاجون إلى حماية قانونية وعدالة فعّالة على المستويين الدولي والوطني، التي تسعى إلى تحقيق العدالة والإنصاف، من خلال تمكين الضحايا من المشاركة في الإجراءات القضائية، والحصول على التعويض، والحماية أثناء المحاكمات سواء تعلق الأمر بالجرائم الدولية، أو الجرائم الوطنية وانتهاكات حقوق الإنسان. إلا أن هناك فجوة لا تزال قائمة بين النصوص القانونية والتطبيق العملي، خاصة وأن الضحايا غالبًا ما يعانون من الإقصاء والإهمال في الإجراءات الجنائية، سواء على المستوى الدولي أو الوطني، لذلك من الضروري تبني مقاربة شاملة تدمج بين الحماية القانونية، والدعم النفسي والاجتماعي، وإشراك الضحايا في عمليات العدالة، وضرورة أيضا تعزيز آليات حماية الضحايا من خلال تحديث التشريعات الوطنية، وتفعيل آليات الإنصاف والتعويض، وتدعيم دور المنظمات الدولية والوطنية، والعمل على تكريس ثقافة احترام حقوق الضحايا كجزء من بناء العدالة وسيادة القانون. ...................... Résume La protection des victimes dans la législation pénale internationale et nationale est un sujet d’une importance capitale, notamment face à l’augmentation des violations graves des droits de l’homme et des conflits armés, ainsi qu’à la multiplication du nombre de victimes nécessitant une protection juridique et une justice efficace aux niveaux international et national. Cette protection vise à réaliser la justice et l’équité, en permettant aux victimes de participer aux procédures judiciaires, d’obtenir réparation, et de bénéficier d’une protection pendant les procès, qu’il s’agisse de crimes internationaux, de crimes nationaux ou de violations des droits humains. Cependant, un fossé persiste entre les textes juridiques et leur application concrète, les victimes étant souvent exclues et négligées dans les procédures pénales, tant au niveau international que national. Il est donc impératif d’adopter une approche globale intégrant la protection juridique, le soutien psychologique et social, ainsi que la participation des victimes aux processus de justice. Il est également nécessaire de renforcer les mécanismes de protection des victimes à travers la mise à jour des législations nationales, l’activation des dispositifs de réparation et d’indemnisation, le soutien au rôle des organisations internationales et nationales, et la promotion d’une culture du respect des droits des victimes, en tant que composante essentielle de la construction de la justice et de l’État de droit.
