النظام القانوني لتسيير النفايات في الجزائر

Abstract

Summary: The great development that experienced the Algerian society and the rise of the standard of living in addition to increasing the spread of different types of waste, all this has caused damage to the environment in general and the individual in particular, which obliged the Algerian legislator to reconsider in the legal system and the promulgation of Law 01-19 which deals with waste-related matters directly, and because of the ineffectiveness of the legal system alone, the tendency of the Algerian State, has the search for mechanisms to manage and execute within the framework of sustainable development, to achieve sustainable governance. .......................... ملخص التطور الكبير الذي عرفه المجتمع الجزائري وزيادة المستوى المعيشي صاحبه زيادة كبيرة في انتشار مختلف أنواع النفايات في البيئة التي تؤدي إلى الإضرار بالبيئة بصفة عامة وبالفرد بصفة خاصة، الأمر الذي ألزم المشرع الجزائري بإعادة النظر في المنظومة القانونية، وإصدار قانون 01-19 المتعلق بتسيير النفايات ومراقبتها وإزالتها المؤرخ في 12 ديسمبر 2001 الذي يتناول المواضيع المتعلقة بالنفايات بصفة مباشرة، ولعدم نجاعة المنظومة القانونية لوحدها اتجهت الدولة الجزائرية إلى البحث عن آليات تقوم بإدارة وتسيير النفايات في إطار التنمية المستدامة، سعيا إلى تحقيق التسييرالمستدام. .............................. Résumé : Le grand développement qui connu la société Algérienne et le élévation du niveau de vie en plus de augmentation de la propagation de différentes types déchets, tout cela a cause des a des dommages a l'environnement en général et l'individu en particulier, ce qui obligeait le législateur algérien reconsidérer dans le système juridique et le promulgation de la loi 01-19 qui traite des sujets liés aux déchets directement, et a cause de l'inefficacité du système juridique seul, la tendance de l'Etat algérienne, a la recherche des mécanismes pour gérer et exécutez dans le cadre de développement durable, pour atteindre le gouvernance durable.
