الإستقلال الوظيفي للقضاة في الجزائر

Abstract

Summary: The functional independence of judges in Algeria requires the judge to adjudicate the disputes before him in all impartiality and independence, whereby no authority or other entity of the State may interfere in its actions by direction or obstruction; He is subject only to the law and during the consideration of the dispute before him, the judge must not be influenced by public opinion, thereby deviating from the means of right and justice and refraining from engaging in non-judicial acts that would make the judge affect his material and personal interests, inevitably resulting in his bias to a party at the expense of the party. The other party, with the aim of ensuring the impartiality and independence of the judge, does not hold him accountable for Algerian and civil liability as a result of the actions he carries out within his competence. ......................... ملخص : یقتضي الاستقلال الوظیفي للقضاة في الجزائر أن یفصل القاضي في المنازعات المعروضة علیه، بكل حیاد واستقلالیة بحیث لا یجوز لأیة سلطة أو جهة أخرى في الدولة التدخل في أعماله سواء بتوجیه أوالعرقلة، فهو لا یخضع إلا للقانون و یجب على القاضي أثناء النظر في النزاع المطروح علیه أن لا یتأثر بالرأي العام فینحرف بذلك عن طریق الحق والعدالة ویمتنع عن ممارسة الأعمال غیر القضائیة التي من شأنها أن تجعل القاضي یتأثر بمصالحه المادیة والشخصیة فیؤدي حتما إلى انحیازه لطرف على حساب طرف الأخر وذلك بهدف ضمان حیاد القاضي واستقلالیته، وعدم تحمیله المسؤولیة الجزائیة والمدنیة نتیجة ما یقوم به من إجراءات تدخل ضمن اختصاصه. ......................

Résumé : L’indépendance fonctionnelle des juges en Algérie exige que le juge statue sur les litiges dont il est saisi en toute impartialité et indépendance, de sorte qu’aucune autorité ou autre entité de l’État ne peut interférer dans ses actions par direction ou obstruction; Il n’est soumis qu’à la loi et lors de l’examen du litige devant lui, le juge ne doit pas être influencé par l’opinion publique, s’écartant ainsi des moyens de droit et de justice et s’abstenant de s’engager dans desles actes judiciaires qui feraient en sorte que le juge affecterait ses intérêts matériels et personnels, ce qui entraînerait inévitablement son parti pris à l’égard d’une partie aux dépens de la partie. L’autre partie, dans le but d’assurer l’impartialité et l’indépendance du juge, ne le tient pas responsable de la responsabilité civile et algérienne résultant des actions qu’il mène dans le cadre de sa compétence.
