Abstract

Summary : The International Humanitarian Fact-Finding Commission (IHFFC) is an independent and impartial body, established under article 90 of Additional Protocol I of 1977, which contributes to the international humanitarian law application as a mechanism for its implementation, in particular following the increase of armed conflicts and the frequent use of prohibited methods and means of combat resulting from the most heinous crimes against humanity, which investigate facts that constitute a grave violation of international humanitarian law rules. and good offices aimed at resolving conflicts peacefully without resorting to war, as well as preventing escalation during conflict and ensuring protection and assistance for victims of such conflicts and violations. The Commission is a very effective mechanism in the field of international humanitarian law application, but despite the importance of its role, it has not been activated since its establishment, because of a series obstacles and difficulties that have prevented it from carrying out its legal functions. .................... الملخص: اللجنة الدولية الانسانية لتقصي الحقائق هيئة مستقلة ومحايدة، أنشئت بموجب المادة 90 من البروتوكول الإضافي الأول لعام 1977، تساهم في تطبيق القانون الدولي الإنساني بصفتها آلية من آليات تنفيذه، لا سيما بعد تزايد النزاعات المسلحة وكثرة استعمال أساليب ووسائل القتال المحظورة، التي أسفر عنها ارتكاب أبشع الجرائم في حق الإنسانية، فهي تقوم بإجراء تحقيقات في الوقائع التي تشكل انتهاكا جسيما لقواعد القانون الدولي الإنساني، وبذل المساعي الحميدة بهدف فض النزاعات بطرق سلمية دون اللجوء الى الحرب، إضافة إلى منع التصعيد أثناء النزاع وضمان الحماية والمساعدة لضحايا هذه النزاعات والانتهاكات . بهذا فإن اللجنة آلية جد فعالة في مجال تطبيق القانون الدولي الإنساني، لكن على الرغم من أهمية دورها لم يتم تفعيلها منذ إنشائها بسبب مجموعة من العراقيل والصعوبات التي منعتها من أداء مهامها المنوطة بها قانونا. ..................... Résumé : La commission internationale humanitaire d'établissement des faits (CIHEF) est un organe indépendant et impartial, créé en vertu de l'article 90 du Protocole additionnel I de 1977, qui contribue à l'application du droit international humanitaire en tant que l'un des mécanismes de sa mise en œuvre. en particulier après l'augmentation des armes conflits et l'utilisation fréquente de méthodes et moyens de guerre interdits, qui ont abouti des crimes les plus odieux pour l'humanité, elle mène des enquêtes sur les faits qui constituent une grave violation des règles du droit international humanitaire et exerce ses bons offices pour régler les différends par des moyens pacifiques sans recourir à la guerre, prévenir aussi les controverses et l'escalade pendant les conflits, et assurer la protection et l’assistance aux victimes de ces conflits. Ainsi, le Comité est un mécanisme très efficace dans le domaine de la mise en œuvre du droit international humanitaire, Cependant, malgré l'importance de son rôle, il n'a pas été activé depuis sa création, à cause d'un ensemble d'obstacles et de difficultés qui l'ont empêché d'accomplir ses missions légales.
