Abstract

Summary: This research draws a presentation of the most important constitutional and political stops in the legislative branch at the institutional and functional levels through Algeria's constitutional development and the effectiveness of the legislative institution in both the legislative and parliamentary oversight areas. As a result of all this, new mechanisms must be adopted that contribute to revitalizing Parliament's role in democratization. This study has provided some solutions for balancing the two Powers, seeking to see real future change on the ground. ...................... الملخص: هذا البحث يستحضر عرض لأهم المحطات الدستورية والسياسية التي شهدتها السلطة التشريعية على المستوى المؤسساتي والوظيفي من خلال التطور الدستوري في الجزائر والوقوف على مدى فعالية المؤسسة التشريعية سواء في المجال التشريعي أو الرقابة البرلمانية. وخلاصة لما سبق نقف إلى أن، البحث المعمق في دراسة البرلمان الجزائري، يكشف لنا عدة تغيرات طرأت عليه، مما أدت إلى تطور دوره من عدة جوانب، خاصة منها تكريس الديمقراطية. إلا أن هذا التطور واجهته العديد من الصعوبات، من قبل السلطة التنفيذية خاصة، سواء في ظل الغرفة الأحادية والتي كانت هنا السلطة التشريعية نسبيا هي الأكثر تحكما في زمام الأمور، من السلطة التنفيذية، أو في ظل الغرفة الثنائية، التي كانت مقارنة بالأحادية الأكثر توسعا في صلاحيات المجلس الشعبي الوطني ومجلس الأمة، إلا أن هذا التوسع لم يشفع لهما فجعلهما الأكثر تقييدا من طرف السلطة التنفيذية، الذي جعل دور البرلمان هنا في تحقيق الديمقراطية مثقل بالعراقيل. ونتيجة لكل هذا يجب انتهاج آليات جديدة تساهم في إعادة إحياء دور البرلمان في تكريس الديمقراطية من هنا قد قدمت هذه الدراسة بعض حلول من أجل الموازنة بين السلطتين، ساعين لنرى تغييرا مستقبلا فعليا على أرض الواقع. .......................

Résumé : Cette recherche propose une présentation des arrêts constitutionnels et politiques les plus importants du pouvoir législatif aux niveaux institutionnel et fonctionnel à travers le développement constitutionnel de l’Algérie et l’efficacité de l’institution législative à la fois et les domaines de surveillance parlementaire.
