الحماية القانونية لذوي الاحتياجات الخاصة في الجزائر

Abstract

Summary: The Algerian legislature is concerned with the category of persons with special needs and has promulgated laws aimed at protecting the rights of this group, promoting them and integrating them into society. The most prominent of these laws is Act No. 09-02 on the rights and promotion of persons with special needs, which affirms the desire to protect this group and take into account their disability. This contributes to the realization of the principle of equality among all members of society. In this regard, we have tried to address the various legal texts that protect the group of persons with special needs in Algeria, as well as the various mechanisms devoted by the legislature to the accomplishment of this task. ....................... ملخص: إهتم المشرع الجزائري بفئة ذوي الاحتياجات الخاصة ، و أصدر قوانين بهدف حماية حقوق هذه الفئة و ترقيتها و إدماجها في المجتمع ومن أبرز هذه القوانين القانون 09-02 المتعلق بحقوق الأشخاص ذوي الاحتياجات الخاصة و ترقيتهم مما يؤكد على الرغبة في حماية هذه الفئة ومراعاة عجزهم ،مما يساهم في إعمال مبدأ المساواة بين جميع أفراد المجتمع وقد حاولنا في هذا البحث التطرق إلى مختلف النصوص القانونية التي توفر الحماية لفئة ذوي الاحتياجات الخاصة في الجزائر،إلى جانب الآليات المختلفة التي كرسها المشرع لإنجاز بهذه المهمة. ................... Résumé : La législature algérienne s’intéresse à la catégorie des personnes ayant des besoins spéciaux et a promulgué des lois visant à protéger les droits de ce groupe, à les promouvoir et à les intégrer dans la société. La plus importante de ces lois est la loi no 09-02 sur les droits et la promotion des personnes ayant des besoins spéciaux, qui affirme le désir de protéger ce groupe et de tenir compte de leur handicap. Cela contribue à la réalisation du principe d’égalité entre tous les membres de la société. À cet égard, nous avons essayé d’aborder les différents textes juridiques qui protègent le groupe de personnes ayant des besoins spéciaux en Algérie, ainsi que les différents mécanismes consacrés par le législateur à l’accomplissement de cette tâche.
