الحماية الدولية للمدنيين أثناء الاحتلال الحربي – دراسة حالة حرب غزة 2023 –2024

Abstract :

The rules of international humanitarian law have tried to make wars more humane by granting protection to the victims of armed conflicts, whether military or civilian, as well as their property, and demonstrating the due treatment towards them. However, the violations and crimes committed in Palestine in general and in the Gaza Strip, especially after Operation Al-Aqsa Flood, showed the ugliness and bloodiness of the crimes committed by the Zionist entity against the people of Palestine. From this standpoint, I tried, through this memorandum, to clarify the rules for protecting civilians and their property and review the various violations of the Zionist entity since the beginning of the aggression against Gaza 2023 of killing, torturing, starving, forcibly deporting people, annexing, seizing and destroying cities and facilities, which holds it civilly and criminally responsible for these criminal acts. Given the ugliness of these aggressive acts, some countries and international organizations intervened to put an end to these massacres, reviewing most of the measures taken by them to stop the agression against the Gaza Strip and establish a ceasefire. Pending strengthening of respect for the rules of international humanitarian law, the residents of the Gaza Strip, the Palestinian people in general, continue to suffer from the heinous crimes committed by the Zionist entity. ................................... ملخص لقد حاولت قواعد القانون الدولي الإنساني جعل الحروب أكثر إنسانية من خلال إضفاء حماية لضحايا النزاعات المسلحة عسكريين كانوا او مدنيين وكذا ممتلكاتهم وابانت المعاملة الواجبة تجاههم. غير أن الانتهاكات والجرائم الواقعة في فلسطين عام وفي قطاع غزة خاصة بعد عملية طوفان الأقصى أظهرت بشاعة ودموية الجرائم التي يرتكبها الكيان الصهيوني في حق شعب فلسطين ومن هذا المنطلق حاولت من خلال هذه المذكرة بيان قواعد حماية المدنيين وممتلكاتهم واستعراض مختلف انتهاكات الكيان الصهيوني منذ بدء العدوان على غزة 2023 من قتل وتعذيب وتجويع وترحيل قصري للأشخاص وضم واستلاء وتدمير المدن والمنشئات الأمر الذي يحملها المسؤولية المدنية والجنائية عن هذه الأفعال الإجرامية. ونظرا لبشاعة هذه الاعمال العدوانية تدخلت بعض الدول والمنظمات الدولية لوضع حد لهذه المجازر استعرضت جل التدابير المتخذة من طرفها من اجل وقف العدوان عن قطاع غزة ووقف إطلاق النار. وفي انتظار تعزيز احترام قواعد القانون الدولي الإنساني يبقى سكان قطاع غزة الشعب الفلسطيني على العموم يعاني بشاعة الجرائم المرتكبة من قبل الكيان الصهيوني. ................................... Les règles du droit international humanitaire ont tenté de rendre les guerres plus humaines en accordant une protection aux victimes des conflits armés, qu'ils soient militaires ou civils, ainsi qu'à leurs biens, et en leur démontrant un traitement dû. Cependant, les violations et les crimes commis en Palestine en général et dans la bande de Gaza, en particulier après l'opération Al-Aqsa, ont montré la laideur et le caractère sanglant des crimes commis par l'entité sioniste contre le peuple palestinien. De ce point de vue, j'ai essayé. à travers ce mémorandum pour clarifier les règles de protection des civils et de leurs biens et passer en revue les différentes violations. Depuis le début de l'agression contre Gaza en 2023, l'entité sioniste a commis des meurtres, des tortures, la famine, des déportations forcées de personnes, des annexions, des saisies. Et la destruction de villes et d'installations, ce qui lui fait porter la responsabilité civile et pénale de ces actes criminels. Face à la laideur de ces actes d'agression, certains pays et organisations internationales sont intervenus pour mettre fin à ces massacres et ont révisé la plupart des mesures prises par eux pour mettre fin à l'agression contre la bande de Gaza et établir un cessez-le-feu. En attendant un meilleur respect des règles du droit international humanitaire, les habitants de la bande de Gaza, le peuple palestinien en général, continuent de souffrir des crimes odieux commis par l'entité sioniste.
