Abstract

Summary The product's civil liability has become important in general. in particular as a result of the evolution in the industrial sphere, which has led to the proliferation and diversity of products that often threaten the life of the consumer and damage its finances, Especially when these products are not guaranteed and do not have sufficient safety and do not conform to the specifications as an effective party in causing serious harm to a vulnerable consumer when offering products for trading with defects, whether hidden or not. ......................... ملخص لقد أصبحت المسؤولية المدنية للمنتج تتمتع بمكانة هامة في المسؤولية بصفة عامة،لا سيما وأنها ناتجة عن التطور الذي عرفه المجال الصناعي والذي أدى إلى انتشار وتنوع المنتجات التي غالبا ما تؤدي إلى تهديد حياة المستهلك والإضرار بأمواله، خاصة عندما تكون هذه المنتجات غير مضمونة ولا تتمتع بدرجة أمان كافية وغير مطابقة للمواصفات، إذ أن هذه المسؤولية فرضت قيود على المنتج، باعتبارها الطرف الفعال في إحداث أضرار جسيمة للمستهلك الضعيف عند طرح منتوجات للتداول مشوبة بعيوب سواء كانت خفية أو غير خفية. ........................... Résumé La responsabilité civile du produit est devenue importante en général. notamment en raison de l’évolution du milieu industriel, qui a conduit à la prolifération et à la diversité des produits qui menacent souvent la vie du consommateur et portent préjudice à ses finances, Surtout lorsque ces produits ne sont pas garantis et n’ont pas une sécurité suffisante et ne sont pas conformes aux spécifications en tant que partie efficace causant un préjudice grave à un consommateur vulnérable lors de l’offre de produits pour le commerce avec des défauts, cachés ou non.
