التعاون الدولي لمكافحة الاتجار بالبشر في ظل القانون 04/23

Abstract

Abstract: Human trafficking is one of the most serious transnational organized crimes that has gained significant attention in recent years. It has become a global concern and a threat to humanity. Due to the prevalence of this phenomenon in all countries without exception, it has become necessary to intensify international efforts to curb its spread. International efforts to combat human trafficking are evident through the signing of international and regional agreements, the establishment of organizations, and the enactment of domestic legislation. Algeria, in turn, has dedicated legislative mechanisms to combat human trafficking by ratifying the relevant international conventions and enacting laws that criminalize this phenomenon, punish its perpetrators, and ensure the protection and support of victims. This is reflected in the Penal Code and the Law on the Prevention and Combating of Human Trafficking No. 23-04. ......................... ملخص المذكرة:

إن جريمة الإتجار بالبشر من أخطر الجرائم المنظمة العابرة للحدود والتي احتلت أهمية كبيرة في الآونة الأخيرة اذ باتت هذه الجريمة مصدر أرق للعالم وتهديد للبشرية، ونظرا لتفشي هذه الظاهرة في كافة الدول دون استثناء أصبح من الضروري تكثيف الجهود الدولية للحد من انتشارها.

وتظهر الجهود الدولية المبذولة في مكافحة جريمة الإتجار بالبشر من خلال توقيع الاتفاقيات الدولية والاقليمية، وإنشاء المنظمات، وسن التشريعات الداخلية.

والجزائر بدورها كرست آليات تشريعية لمكافحة جريمة الإتجار بالبشر عن طريق المصادقة على الاتفاقيات المتعلقة بمكافحة الإتجار بالبشر وسن قوانين تجرم هذه الظاهرة وتعاقب مرتكبيها وتضمن الحماية والمساندة للضحايا وهذا ما جاء به قانون العقوبات، والقانون الخاص بالوقاية من الإتجار بالبشر ومكافحته رقم 23-04. .......................... Résume La traite des êtres humains est l’une des formes de criminalité transnationale organisée les plus graves qui a retenu l’attention ces dernières années. C’est devenu une préoccupation mondiale et une menace pour l’humanité. En raison de la prévalence de ce phénomène dans tous les pays sans exception, il est devenu nécessaire d’intensifier les efforts internationaux pour freiner sa propagation. Les efforts internationaux pour lutter contre la traite des êtres humains se manifestent par la signature d'accords internationaux et régionaux, la création d'organisations et la promulgation de lois nationales. L'Algérie, à son tour, a consacré des mécanismes législatifs à la lutte contre la traite des êtres humains en ratifiant les conventions internationales pertinentes et en promulguant des lois qui criminalisent ce phénomène, punissent ses auteurs et assurent la protection et le soutien des victimes. Cela se reflète dans le Code pénal et la loi n° 23-04 sur la prévention et la lutte contre la traite des êtres humains.
