Abstract

Summary : Administrative control is one of the most prominent issues on the international scene in general and Algeria in particular, which is reflected in the overall measures taken by the central State authorities, as well as by the non-centralized and decentralized measures, in accordance with the gradient of the administrative pyramid and the principle of independence. Although the prime Minister has practical competence in the area of administrative control, the Algerian legislature has not explicitly stated this power in Constitutional Amendment 2020, as in other previous constitutions. This study showed the role of the prime Minister (Head of Government), whose powers have been reflected, in particular, in the area of administrative control and their impact on the maintenance of public order in the broad sense . We have found this through his executive decrees and ministerial instructions, which contain a number of legal articles, including procedures, measures and restrictions on the freedoms and rights of individuals, using legal, material and human means that guarantee the safety of society and the prevention from dangers, especially in ordinary circumstances. ..................... ﻣﻠﺧص اﻟﺿﺑط اﻹداري ﻣن أﺑرز اﻟﻣواﺿﯾﻊ اﻟﻣطروﺣﺔ ﻋﻠﻰ اﻟﺳﺎﺣﺔ اﻟدوﻟﯾﺔ ﻋﺎﻣﺔ واﻟﺟزاﺋر ﺧﺎﺻﺔ، وﯾﺗﺟﻠﻰ ﻣوﺿوﻋﻪ ﻓﻲ ﻣﺟﻣل اﻟﺗداﺑﯾر اﻟﺗﻲ ﺗﻧﺗﻬﺟﻬﺎ ﺳﻠطﺎت اﻟدوﻟﺔ اﻟﻣرﻛزﯾﺔ،ﻏﯾر اﻟﻣﻣرﻛزة واﻟﻼﻣرﻛزﯾﺔ وﻓﻘﺎ ﻟﺗدرج اﻟﻬرم اﻹداري وﻣﺑدأ اﻻﺳﺗﻘﻼﻟﯾﺔ. ورﻏم أن اﻟوزﯾر اﻷول ﺻﺎﺣب اﻻﺧﺗﺻﺎص اﻟﻌﻣﻠﻲ ﻓﻲ ﻣﺟﺎل اﻟﺿﺑط اﻹداري، إﻻ أن اﻟﻣﺷرع ﻟم ﯾﺗﻌرض ﻟﺗﻣﺗﻌﻪ ﺑﻬﺎﺗﻪ اﻟﺳﻠطﺔ ﺻراﺣﺔ ﻓﻲ اﻟﺗﻌدﯾل اﻟدﺳﺗوري ﻟﺳﻧﺔ 2020 ﻛﻐﯾرﻩ ﻣن اﻟدﺳﺎﺗﯾر السابقة. وﻟﻘد أظﻬرت ﻫذﻩ اﻟدارﺳﺔ دور اﻟوزﯾر اﻷول (رﺋﯾس اﻟﺣﻛوﻣﺔ)اﻟذي ﺗﺟﺳدت ﺻﻼﺣﯾﺎﺗﻪ ﺧﺎﺻﺔ ﻓﻲ ﻣﺟﺎل اﻟﺿﺑط اﻹداري وأﺛرﻫﺎ ﻓﻲ اﻟﻣﺣﺎﻓظﺔ ﻋﻠﻰ اﻟﻧظﺎم اﻟﻌﺎم ﺑﻣﻔﻬوﻣﻪ اﻟواﺳﻊ، ﺣﯾث وﻗﻔﻧﺎ ﻋﻠﻰ ذﻟك ﻣن ﺧﻼل ﻣﺎ أﺻدرﻩ ﻣن ﻣراﺳﯾم ﺗﻧﻔﯾذﯾﺔ وﺗﻌﻠﯾﻣﺎت وزارﯾﺔ ﺗﺗﺿﻣن ﺟﻣﻠﺔ ﻣن اﻟﻣواد اﻟﻘﺎﻧوﻧﯾﺔ ﺗﺗﺧﻠﻠﻬﺎ إﺟراءات وﺗداﺑﯾر ﺗﺿﺑط وﺗﻘﯾد ﻣن ﺣرﯾﺎت وﺣﻘوق اﻷﻓارد، ﺑﺎﺳﺗﻌﻣﺎل وﺳﺎﺋل ﻗﺎﻧوﻧﯾﺔ،ﻣﺎدﯾﺔ وﺑﺷرﯾﺔ ﺗﺿﻣن ﺳﻼﻣﺔ المجتمع ووقايته من كل الأخطار، خاصة في الظروف الإستثنائية في ظل الحالات العادية . ............... Résumé Le contrôle administratif est l’un des sujets les plus importants sur la scène internationale en général et en Algérie en particulier. Son sujet se reflète dans les mesures globales prises par les autorités centrales de l’État, qui ne sont pas centralisées et décentralisées conformément à la graduation de la hiérarchie administrative et au principe d’indépendance. Bien que le premier ministre ait une compétence pratique dans le domaine du contrôle administratif, le législateur n’a pas été expressément soumis à un tel pouvoir dans la modification constitutionnelle de 2020 comme dans les constitutions précédentes. Cette étude a démontré le rôle du Premier Ministre (Chef du Gouvernement), dont les pouvoirs se sont reflétés notamment dans le domaine du contrôle administratif et son impact sur le maintien de l’ordre public au sens large. les droits de la personne, « et nous avons maintenu ce principe par ses décrets exécutifs et ses instructions ministérielles, qui contiennent un certain nombre d’articles juridiques, entrecoupés de procédures et de mesures qui contrôlent et restreignent les libertés et les droits de la personne, en moyens matériels et humains pour assurer la sécurité et la protection de la société contre tous les dangers, en particulier dans des circonstances exceptionnelles dans des circonstances normales.
