Abstract

Summary: The patent is the bond or certificate granted by the State to the inventor. (The holder of the patent) has solicitative rights and is therefore entitled to prevent the exploitation or use of another person, as well as to certain obligations such as the obligation to pay fees and the obligation to exploit the innocence within a legally prescribed period. ...................... ملخص : تعتبر براءة الاختراع هي السند أو الشهادة التي تمنحها الدولة للمخترع فالمشرع الجزائري وضع لنا الأمر 07/03 المتعلق ببراءات الاختراع وقد بين من خلاله مجموعة من الشروط منها ما يتجلى في الشروط الموضوعية وأخرى شكلية،ومن ذلك برزت لنا العديد من الخصائص منحت للعامل تتمثل في ان البراءة حق مؤقت مقيد بالاستغلال وذو خاصية مالية وأنه مرتبط بصدور وثيقة تسليم لحماية الاختراع . وبمجرد حصول العامل على وثيقة براءة الاختراع تكسبه أهمية كبيرة فمنها ماهو حق أدبي لا يمكنه التصرف فيه عكس الحق المالي فهو يهدف إلى طمئنة المخترعين على حقوقهم فلذلك وضع المشرع جملة من الحقوق والالتزامات على عاتق العامل (صاحب البراءة)فله حقوق استئثارية لذا يحق له منع الغير من استغلاله أو استعماله كما قيده ببعض الالتزامات كالالتزام بدفع الرسوم والالتزام باستغلال البر اءة في مدة محددة قانونا. ...........................
