Abstract

Summary: Intellectual property rights are one of the most important rights that relate to the various creations of the intellectual mind by guaranteeing their owners the right to exploit and dispose of their creations and enjoy their economic fruits. Some countries recognize many types of intellectual property that are divided into industrial, commercial, and other moral and artistic property, if the rights of industrial and commercial property include both industrial drawings and models. Integrated designs and circles, as well as trademark and names of origin, as well as literary and artistic property rights are copyright and adjacent rights, Given the role that intellectual property rights play in the economic sphere, this exposes them to many violations that would affect rights holders. These attacks consist mainly of the crime of tradition, which obliges Algerian legislation to provide legal protection for these rights, since civil protection alone is not sufficient. So the Algerian legislature approved more stringent penal protection, So to reduce this crime and this through legal texts and intellectual property rights orders, Nevertheless, Algerian legislation still lacks many procedures to guarantee legal protection, particularly adequate penal protection of intellectual property rights. ........................ الملخص: ان حقوق الملكية الفكرية هي من أهم الحقوق التي تتعلق بمختلف ابداعات العقل الفكري اذ تكفل لأصحابها الحق في استغلال ابداعاتهم والتصرف فيها والتمتع بثمارها الاقتصادية ، حيث تعترف بعض الدول بالعديد من أنواع الفكرية والتي تنقسم الى ملكية صناعية وتجارية واخرى ادبية والفنية، اذا تتضمن حقوق الملكية الصناعية والتجارية كل من براءة الاختراع الرسوم والنماذج الصناعية, التصاميم والدوائر المتكاملة, وكذا العلامة التجارية وتسميات المنشأ, اما عن حقوق الملكية الأدبية والفنية فتتمثل في حقوق المؤلف والحقوق المجاورة, ونظرا لدور الذي تلعبه حقوق الملكية الفكرية في المجال الاقتصادي فهذا عرضها للعديد من الانتهاكات التي من شأنها المساس بأصحاب الحقوق, وتتمثل هذه الاعتداءات اساسا في جريمة التقليد, مما وجب على المشرع الجزائري النص على حماية قانونية لهاته الحقوق اذ لا تكفي الحماية المدنية وحدها, لذا اقر المشرع الجزائري حماية جزائية اشد ردعا واكثر صارمة, ذلك للحد من هذه الجريمة وهذا من خلال نصوص قانونية وأوامر متعلقة بحقوق الملكية الفكرية, وبالرغم من كل ذلك فالمشرع الجزائري لازال يفتقر إلى العديد من الاجراءات لضمان الحماية القانونية وبالأخص الحماية الجزائية الكافية لحقوق الملكية الفكرية. .....................

Résumé : Les droits de propriété intellectuelle sont parmi les droits les plus importants liés aux diverses créations de l'esprit intellectuel, car ils garantissent à leurs propriétaires le droit d'exploiter et de disposer de leurs créations et de profiter de leurs fruits économiques. Certains pays reconnaissent de nombreux types de propriété intellectuelle, qui sont répartis en propriété industrielle, commerciale, littéraire et artistique. Et les brevets commerciaux, dessins et modèles industriels, dessins et circuits intégrés, ainsi que les marques et appellations d'origine.
