آليات ادارة الجماعات المحلية في ظل كوفيد 19

Abstract

Abstract: Local communities are the basis of decentralization and an effective tool to achieve and practice democracy and for ensuring public security at the local level and to ensure its implementation with reference to both Law 12/07 related to the state and Law 11/10 related to the municipality, both the governor wali and the mayor in their capacity as representatives of the state At the local level and by virtue of the broad powers granted to them by the central bodies to maintain security and public order through the local approach between them and the distribution of competencies for each of them within the limits of the laws and regulations in force and without violating the laws that govern them. And in an effort by the state to control the public interest of citizens, and in light of the emergence of the so-called emerging coronavirus, Covid 19, which paralyzed all countries of the world as a whole, and Algeria was not an exception to it, the state in all its bodies hastened to preserve the public health of its citizens at the local level as the great challenge to this exceptional circumstance. All preventive precautionary measures were taken within the framework of the health vigilance system, which received wide approval and an effective response among the citizens, especially since this deadly novelty (Covid 19) has spread throughout the countries of the world despite the mechanisms monitored to stop its spread, curb it and reduce its danger. So control it.

الملخص: تعد الجماعات المحلية قاعدة اللامركزية و أداة فعالة لتحقيق وممارسة الديمقراطية و استتاب الأمن العام على المستوى المحلي و السهر على تطبيقه بالرجوع إلى كل من القانون 07/12 المتعلق بالولاية و القانون 10/11 المتعلق بالبلدية فان كل من الوالي و رئيس البلدية بصفتهما ممثلان للدولة على المستوى المحلي وبحكم الصلاحيات الواسعة الممنوحة لهما من طرف الهيئات المركزية لحفظ الأمن و النظام العام من خلال المقاربة المحلية بينهما وتوزيع الاختصاصات لكل منهما في حدود القوانين و التنظيمات المعمول بها ودون مخالفة القوانين التي تحكمها . و سعيا من الدولة إلى ضبط الصالح العام للمواطنين و في ظل ظهور ما يسمى بفيروس كورونا كوفيد 19 المستجد الذي شل جميع بلدان العالم قاطبة و الجزائر لم تكن استثناء منه فسارعت الدولة بجميع هيئاتها إلى حفظ الصحة العمومية لمواطنيها على المستوى المحلي باعتباره التحدي الكبير لهذا الظرف الاستثنائي حيث تم في اتخاذ جميع التدابير الاحترازية الوقائية في إطار نضام اليقظة الصحية الذي لقي استحسان واسعا وتجاوبا فعالا لدى المواطنين لا سيما ان هذا المستجد الفتاك (كوفيد (19) سارع في الانتشار عبر بلدان العالم رغم الآليات المرصودة لوقف تفشيه و كبح جماحه و التقليل من خطورته و بالتالي السيطرة عليه. Résumé : Les communautés locales sont la base de la décentralisation et un outil efficace pour atteindre et pratiquer la démocratie et pour assurer la sécurité publique au niveau local et pour assurer sa mise en œuvre en référence à la fois à la loi 12/07 liée à l’État et à la loi 11/10 liée à la municipalité, le gouverneur wali et le maire en leur qualité de représentants de l’Etat au niveau local et en vertu des pouvoirs étendus qui leur sont conférés par les organes centraux pour maintenir la sécurité et l’ordre public par l’approche locale entre eux et la répartition des compétences pour chacun d’eux dans les limites des lois et règlements en vigueur et sans violer les lois qui les régissent. Et dans un effort de l’État pour contrôler l’intérêt public des citoyens, et à la lumière de l’émergence du soi-disant coronavirus émergent, la COVID-19, qui a paralysé tous les pays du monde dans son ensemble, et l’Algérie n’y faisait pas exception, l’État dans tous ses organes se hâtait de préserver la santé publique de ses citoyens au niveau local comme le grand défi à cette circonstance exceptionnelle. Toutes les mesures préventives de précaution ont été prises dans le cadre du système de vigilance sanitaire, qui a reçu une large approbation et une réponse efficace parmi les citoyens, surtout depuis cette nouveauté mortelle (Covid 19) s’est répandu dans tous les pays du monde malgré les mécanismes contrôlés pour arrêter sa propagation, la freiner et réduire son danger. Alors, contrôlez-le.
