Abstract

Summary: After this presentation of the topic of employment accident insurance in Algerian legislation, through which we have witnessed the formation and development of employment accident insurance at the international, national and Arab levels and set out the elements identified by the Algerian legislature to consider the injury as a work accident, as well as the situations in which protection extends to incidents outside the spatial and temporal scope of work and when the worker is under the authority and control of the employer, We have also touched upon the area of compensation for work accidents in terms of persons, damages and the basis for compensation and the practical and legal evidence of compensation payable to the injured worker or his/her relatives. s rights ", giving us the legal method to ensure compensation and how to take the necessary action to entitle it to the impact of the injury caused by the work accident. ................................ الملخص : بعد هذا العرض لموضوع التأمين على حوادث العمل في التشريع الجزائري والذي لمسنا من خلاله نشأة وتطور تأمين حوادث العمل على المستوى الدولي والوطني والعربي ، وبينا العناصر التي حددها المشرع الجزائري لإعتبار الإصابة حادث عمل وكذلك ذكرنا الحالات التي تمتد فيها الحماية لتشمل الحوادث التي تقع خارج النطاق المكاني والزماني للعمل وفي الفترات التي يكون فيها العامل خاضعا لسلطة ورقابة رب العمل ، كما تطرقنا الى مجال التعويض عن حوادث العمل من حيث الأشخاص والأضرار وبينا الأساس في التعويض والدليل العملي والقانوني للتعويضات المستحقة للعامل المصاب أو لذويه ، اذ أعطينا الطريقة القانونية لضمان التعويض وكيفية اتخاذ الإجراءات اللازمة لإستحقاقه على اثر الإصابة الناتجة عن حادث العمل . ............................. Résumé : Après cette présentation du thème de l’assurance accidents du travail dans la législation algérienne, à travers laquelle nous avons assisté à la formation et au développement de l’assurance accidents du travail à l’international, aux niveaux national et arabe et énoncent les éléments identifiés par le législateur algérien pour considérer la lésion comme un accident du travail, ainsi que les situations dans lesquelles la protection s’étend aux incidents hors du cadre spatial et temporel du travail et lorsque le travailleur est sous l’autorité et le contrôle de l’employeur, nous avons également abordé le domaine de l’indemnisation des accidents du travail en termes de personnes, les dommages et intérêts, le fondement de l’indemnisation et la preuve pratique et juridique de l’indemnisation payable au travailleur blessé ou à ses/ses proches. Les droits ", nous donnant la méthode légale pour assurer l’indemnisation et comment prendre les mesures nécessaires pour l’habiliter à l’impact de la blessure causée par l’accident du travail.
